if it is approved under a(6) it wont make much sense since this is the EAD you would apply for prior to filing i485 (AOS). You dont have a copy of your submittance? if not, I guess you will have to wait and see.

I have a copy of the application, and couple of days prior to apporval I had called USCIS and made an official service request for the category to be changed from a (6) to c(9). I am sure they should take it into consideration before approving.

Any advice or information on this would be helpful.

If you submitted I-765 with I-485 then you should have used code ( c)(9). If you used (a)(6) then 1 of 2 things might happen:

- a kind case officer will correct your mistake and approve the I-765

- an unkind case officer will deny the I-765 because it was submitted under the wrong category.

Apparently you had a kind case officer.

I am facing a problem regarding my 1-765 form. In the eligibility section of the I-765 form we entered the code as "(a) (6)" rather than "© (9)". Will this effect the EAD processing?.

I submitted the I-765 with the I-485 and now the EAD is approved. I am afraid if it is approved under (a) (6) or © (9)? I hope it is approved as a 240 day card. Kindly provide any information on this.

Thanks a lot yodrak, for the information. I had made a service request on the phone and immediately after this the case was approved. So it make sense that it was under c (9).

Question..I may have posed this before..but has anyone ever NOT received a response from USCIS? If you ahve received, how long has it taken?

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

I have made inquiries through the NCSC twice - got transferred to a real USCIS person and they told me they would submit inquiries. Didn't get a response to either one.

The best place to get information and action is a District or Sub office. But even there they cannot force a response from a Service Center, they can only put in a request.

s- i put in 4 service requests. I only received a response from one I made in October 06. They replied in March 07.

I am sure they figured it out themselves. At least it has been approved. Conngratulations!

I just realized that I made the same mistake on the I-785. I put a(6) instead of c(9). We called them and of course it was of no help. The first officer I spoke to said that it had to be my husband who called since he is the one the EAD is for. I had him call and they told him that their system did not show any mistake...although they wouldn't say if the code needed to be changed or not. They said if we were not happy with their response, to make an InfoPass. :wacko:

NOA1: 2-5-07

BIOMETRICS: 2-21-07

AOS Interview: Decision Pending :( FBI Name Check not completed

Email welcoming New Resident on 5/22/07.

Removal of Conditions now in progress

Mailed: 3-4-09

USCIS received: 3-6-09

NOA1: 3-9-09

Biometrics: letter arrived 3-18-09, scheduled 3-28-09

Approved on: 05-04-2009

Approval letter arrives: 05-09-09

waiting on green card...
