Because its taking too long. On average the process takes between 6-7 months for approval its past 9 months now! The fact that my fiance who I'm petitioning for is restricted from coming into the US currently may have something to do with it. She was staying with me from October- December of last year in early December we left together and I brought my family as well to see hers for the first time. We stayed for a week and then upon going back to the US my fiance only had a one way ticket to the US. They stopped her and interrogated us for 4 hrs, then stated that she has plans to stay in the US that we planned to get married so she is restricted from coming to the US until she gets a CR-1 or K-1 visa. I told them if the one way flight is a problem ill purchase a flight now for her to come back they said no take a seat over there and took our passports. I believe in their eyes that I tried to sneak her in and marry her real quick which is why she is restricted amd that our relationship is a sham. Only thing i can think of as to why this is dragging out and taking so long. I expect an rfe or denial to justify why it is taking them so long.

Here we are on October 12th and i received my receipt number and acknowledgement that they received my case on January 12th! Ive heard nothing since. I spoke to a tier 2 officer last week to look into expediting my case and was turned down. I submitted an inquiry sept 15th and the deadline for them to respond said october 7th. I called just before end of september and a woman told me that an officer is working on my case. Then said i should back by.. I interrupted her and said let me guess october 7th and she said no tmrw sept 30th. That date has come and gone. I called again and a woman said that is incorrect they dont have to respond to you for a month (30 days from time you filed) so they have until october 16th to respond to you. I called again got a tier 2 officer on phone i said im getting the runaround i hear sept 30, october 7, now october 16 what is the deal?! He said that the sept 30 date was the target date they set to respond back to you and sometimes they go past that date and that i could hear back possibly s couple of days later, then said that is correct they have 30 days to respond to your case. I said in regards to a response what am i expecting? I shouldnt expect approval or dissaproval right? He said when you get a response it is just them letting you know what is currently going on with your case!! That it wont be whether its approved or dissaproved. Then i said no one is working in my case is there. He says oh no not at all, and i replied oh so im just getting smoke blown up my butt then. He goes i cant see whats going on as i dont have the access or authority but i can see that no one is currently working on your case that is correct. I then said so i should hear by october 16th huh? He said yes they have a deadline of october 16th. I said has there been cases where they have gone past the deadline? He says oh yes there have been. Then i said ok if i were to be one of those people which i fully expect to be what would someone in my position do?! He says if you dont hear by the deadline then just submit another inquiry LOL. I call back a few days later to another tier 2 officer and he says an officer has been assigned to my case and i should hear back by the end of the month. I said sorry that is bs i just spoke to another tier 2 officer and he said no one is working on my case, and i spoke to someone else who said that someone is working on my case. I explained that ive known her for 6 yrs that weve been together for almost 2-1/2 yrs i just spent 6 months with her in Aruba, that she was in US last yr with me from april- june and oct-dec. And he said you want to marry her i said id like to if you guys allow it, and said shes restricted from entering the US now. Esta restricted her saying she needs a visa to be able to return.

He put into have my case expedited and as i said before it got shot down. Right now our case is in limbo our lives are on hold as she put it. Im beginning to feel as if our relationship is in danger. And am completely clueless as to what to do.

This is pretty identical to what we are experiencing.... total bullshit.

She is restricted by ESTA she cannot enter US soil without a visa. As i explained before upon returning to the states US customs stopped her because they seen that she had a one way flight to the states with NO return ticket back to Aruba where she is from. That drew red flags the US customs lady would not here me out at all said take a seat took both our passports and next thing you know they are interrogating both of us seperately. And come to the conclusion that my fiance is planning to come to the US with me and stay. My fiance argued she has a dutch passport that allows her to stay 3 months. They respond thats all well and good but that passport is visiting she plans on staying, which is why she got only a one way ticket! They would not hear me out at all. They said she needs a visa plain and simple until she gets one she cannot enter the US. They finger printed her and everything. They sent her an email which stated according to ESTA she is restricted from going to the US until she acquires a Visa. I just got back after being with her for 6 months and they gave me a hard time searching all my bags and asking all sorts of questions. We're on their list for sure.

Ive been calling USCIS off the hook today i get told why dont you go to a local immigration office? I said your gonna tell me that an office in NY is gonna be able to help me more than your office over at TSC where all my paperwork is?? That makes alot of sense. I made the appointment which is october 27th and im sure it will be as helpful as when I call USCIS and speak to pretty much anyone over there. The lady on the phone tried transferring me to tier 2 officer as I requested but they said all officers are busy and give you a call back in 47 minutes which will go past 6pm when the office closes, so what is the point of that?? I call back again tired of being

nice i get told ill try and help you sir best i can. Telling me things i already know such as when i filed the I-129F and oh i see its past the normal processing time ( well no ). I told her i submitted an inquiry and the deadline is in 3 days and she goes well i can submit another inquiry i say what is the point in that when they havent responded to the first one and aren't going to. She continues takes my info name and DOB then tries to squeeze this question in are you 2 married? I said no, then she asks for my address i said holdup why did you just randomly ask if were married in between basic normal questions such as my DoB and address???! Obviously not that is what we are trying to do.. She says oh im just checking sir ( sure just wanting me to slip up is what it is as the convo is recorded and they can use it against me later on). After shes done getting my info she says ok well i see you submitted an inquiry on August 15th ( you mean Sept 15th jackass didnt say that but wanted to) and unfortunately i cant submit an inquiry because.. I interrupted her and said because I havent gone past the deadline of October 16th and she says yes ( well duhhh i told you that in the beginning of our convo ya moron!! That the deadline of my inquiry is in 2 days). She says well you can make an appointment with your local immigration office i said yup just did that 5 minutes ago. She replies well you can submit another inquiry once it goes past the deadline. I said what is the point of that when they wont honor the first one they're just not going to answer again. She replies im sorry but theres nothing i can do. I say its been over 9 months normal processing times are 6-7 months. Theyve skipped over me for whatever reason that is, and you cant tell me anything??! Am i red flagged or something? She goes i dont see any flags or denial or anything. She then replies theres nothing i can do but to tell you to wait. LOL

We finally got our electronic NOA2 yesterday - 264 days after the NOA1 and 57 days after the RFE acknowledgement. So, they pretty much took up the whole 60 days after receiving the RFE. We did initiate a case inquiry last week for outside normal processing timeline, but don't know whether that made any difference. now for the next stage. At least it has now left the black hole of TSC. Good luck everyone.

We finally got our electronic NOA2 yesterday - 264 days after the NOA1 and 57 days after the RFE acknowledgement. So, they pretty much took up the whole 60 days after receiving the RFE. We did initiate a case inquiry last week for outside normal processing timeline, but don't know whether that made any difference. now for the next stage. At least it has now left the black hole of TSC. Good luck everyone.

Congrats to those who have either been approved or at least heard or received something on their case. I don't wish what me and my fiance are going through on anyone. I don't see any light at the end of this dark tunnel.

I feel the same way , like two days ago someone with the same date as you got news and yesterday also other people so hopefully we hear something very soon .

I dont expect to hear anything regarding my case anytime soon if not ever. I just told a tier 2 officer to go F*** himself! LOL ?? ???

He kept saying my case is normal processing times i argued its past 9 months!! That is bs that normal processing times is 6-7 months. He stuck to his guns and said it is normal processing times your case is still pending have a good day then I dropped him the F bomb. I tried calling back and getting another tier 2 officer on the phone now i get put on hold and line hangs up they dont want to talk to me. Im on their ? list for sure ??

We contacted a congressman, they sent us a letter saying they were looking into it. But that was two weeks ago.

Now I see that the TSC is working on January 19, and we filed January 7th. I'm a little bit more than peeved right now. I feel like we, along with other people, have been lost at TSC. Forgotten.

So I submitted an inquiry, and it said they would respond by October 15. And we are going to call to bother them again.

This is suppose to be only the first step in a long process, I have no idea even where my interview will take place. Or how I am suppose to get there. I do apologize, I know a lot of you guys are in this same boat.

This is just ridiculous.

They responded to the inqury, and said our paper work is with an agent and we will hear something in 45 days maybe. Lol.

I can report that our Petition was Approved yesterday. Our Noa1 was January 13. We got an RFE August 13. It took 9 days to receive the RFE in the mail to know what they were looking for. It took me a while to respond because I wanted to include a letter of explanation from a Japanese lawyer regarding the paperwork we were submitting with the RFE. They received our RFE response on September 17. The Approval was October 15, about 28 days after they received the RFE.

It is with a somewhat heavy heart that I report this news because so many here are still waiting, including Vanamali who received a very similar RFE to us.

I will continue to pay close attention to this thread and provide any guidance I can to anyone who has questions or concerns.

I used my Congressman a lot to keep my case moving forward and I can, upon request, give more details about what I did with the Congressman and how I believe that helped.
