Hello,

We’re December filers (day 299 of waiting today). USCIS told us that our case was in background checks at the beginning of September and our senator came back to us a week ago saying that it was with an adjusting officer (finally!) I still don’t know what that means in terms of how much longer we have to wait though. It’s so frustrating and heart-breaking to just be strung along like this L

At one point I had both a Senator and a Congressman contacting USCIS for me. The Congressman's office was MUCH more responsive to me. They were all over USCIS and called me and sent letters to me, etc. The Senator's office left one e-mail telling me nothing.

Try the Congressman.

You're getting very close to the 60 days since your RFE. So I think you should raise the heat.

Just like you, I needed a lawyer's letter of explanation for the divorce documentation from Asia. That took longer than I hoped and they didn't get my RFE response until September 17th. I figure just like you I won't hear anything until the 60 days gets close, or goes by, so I'm waiting until mid-November before I call the Congressman again.

But you're closer to the 60 days, so maybe you should get the Release for the Congressman signed and have them ready to make inquiries for you on day 61.

Oh, I called USCIS today. They said that if 60 days goes by and there is no answer to the RFE we can ask for an inquiry. In my view the person to ask for that inquiry should be the Congressman. That's my plan anyway.

We rang USCIS again today as it is 50 days since our RFE acknowledgement and they agreed to initiate a case inquiry which will take between 15-30 days to hear anything on. Can you believe it! More waiting!

Hi Eric,

I need to reach a congress man. Thank you for the boost. Meanwhile, unfortunately my relationship is getting weaker and weaker. It is hard to hold a relationship in India for long. I am not sure if it can survive next several months.

Now I got a new concern. Will the US marriage registration have any problem if we try to register the marriage with my fiancee with this divorce decree.

I am glad you got the Congressman's office involved. They are more "local" than Senators and my experience so far, as I said, is that they are more responsive to us.

I am not sure I understand your second question, but let me take a try at answering...If you are asking whether a Mutual Consent divorce is going to cause a problem with your marriage here after you get all the way through the K-1 process, then the answer is: No..It will not be any problem at all. You and your fiance will be able to get married here if she gets the K-1 visa.

If that is not your question please re-phrase it and I will try to answer.

By the way, has anyone had an approval recently out of TSC. My impression is that they have really slowed down, but I'm not sure. There are some people who used to be on this thread a lot who I haven't seen for a while, so maybe they got good news.

Anyway, I will admit that I am in the utter depths of hell with this entire process and want to scream almost every hour of the day. But I hold it in and endure. The only thing that makes it bearable is trying to help others here and chatting with my fiance every day, no matter what. (She's in Japan).

Anyway, if anyone has a question or a thought I will try to respond. I don't know more than anyone else, but sometimes it is good to get someone else's perspective. With the Petition for myself and my fiance I can't look at it logically and I freak out over every little thing because I am really terrified it is going to be denied for a bogus reason or some ridiculous petty screw up. But for others I find I can be more calm and logical. I think it is that way for most of us.

So, let's hang in there and try to help each other in any way we possibly can.

Vanamali....I must admit that I'm doing the "look ahead" also and wondering if I ever get to NOA2 how that darned Mutual Consent divorce is going to snap back and bite us at the next stage. I've thought a whole lot about it and my own view is this: If we can get to NOA2 the Mutual Consent divorce is no longer an issue at any of the further stages. I could be wrong, but I don't think so. I've researched the heck out of it and I just don't see it popping up as an issue anywhere else. We just gotta get approved at TSC my friend!!!!

Hello Eric - Have you tried taking a copy of the Mutual Consent Divorce to your local court and ask if it is admissible proof of divorce to get married? The requirement (for divorcees) is to have prior marriage certificate and divorce decree to get the license. Usually the court people are helpful.

You are right - the Jan and Feb threads have emptied out so feels slow. I think they peaked out in August. It is really heart wrenching to see cases like you and Vanamali and not have the ability to help. I hope to hear some good news from you folks.

08/03/2015: Mailed response overnite

08/04/2015: Tracking showed TSC received

08/05/2015: TSC acknowledged that my RFE was received

How much time it takes for the congress man to respond. I did two business days back. I contacted them through the email. Should I go in person.

Regarding the marriage and the mutual consent divorce decree, I think it depends on the county. It appears in my county we need to produce the divorce certificate if the divorce happened within the 6 months.

Here we are on October 12th and i received my receipt number and acknowledgement that they received my case on January 12th! Ive heard nothing since. I spoke to a tier 2 officer last week to look into expediting my case and was turned down. I submitted an inquiry sept 15th and the deadline for them to respond said october 7th. I called just before end of september and a woman told me that an officer is working on my case. Then said i should back by.. I interrupted her and said let me guess october 7th and she said no tmrw sept 30th. That date has come and gone. I called again and a woman said that is incorrect they dont have to respond to you for a month (30 days from time you filed) so they have until october 16th to respond to you. I called again got a tier 2 officer on phone i said im getting the runaround i hear sept 30, october 7, now october 16 what is the deal?! He said that the sept 30 date was the target date they set to respond back to you and sometimes they go past that date and that i could hear back possibly s couple of days later, then said that is correct they have 30 days to respond to your case. I said in regards to a response what am i expecting? I shouldnt expect approval or dissaproval right? He said when you get a response it is just them letting you know what is currently going on with your case!! That it wont be whether its approved or dissaproved. Then i said no one is working in my case is there. He says oh no not at all, and i replied oh so im just getting smoke blown up my butt then. He goes i cant see whats going on as i dont have the access or authority but i can see that no one is currently working on your case that is correct. I then said so i should hear by october 16th huh? He said yes they have a deadline of october 16th. I said has there been cases where they have gone past the deadline? He says oh yes there have been. Then i said ok if i were to be one of those people which i fully expect to be what would someone in my position do?! He says if you dont hear by the deadline then just submit another inquiry LOL. I call back a few days later to another tier 2 officer and he says an officer has been assigned to my case and i should hear back by the end of the month. I said sorry that is bs i just spoke to another tier 2 officer and he said no one is working on my case, and i spoke to someone else who said that someone is working on my case. I explained that ive known her for 6 yrs that weve been together for almost 2-1/2 yrs i just spent 6 months with her in Aruba, that she was in US last yr with me from april- june and oct-dec. And he said you want to marry her i said id like to if you guys allow it, and said shes restricted from entering the US now. Esta restricted her saying she needs a visa to be able to return.

He put into have my case expedited and as i said before it got shot down. Right now our case is in limbo our lives are on hold as she put it. Im beginning to feel as if our relationship is in danger. And am completely clueless as to what to do.

That sounds absolutely horrifying. I'm so sorry to hear your two are going through this. I hope you have tried to contact a rep in your state. This is unacceptable.

Hey stephanie yea i don't have a clue what to do. I tried contacting a congress woman this past march to get my case expedited they turned me down. I just tried to get my case expedited being that they passed me over a while ago and was turned down stating my case is not an emergency as i dont fall under requirements to be together. I know no one is working on my case and i fully expect for them not to respond by the deadline of october 16th as there are no penalties they would receive if they were to do so. I can contact a rep but i dont know what good that would do me. I read this chat forum all the time and im seeing people just us who've contacted senators and congress people and a month later have not heard a work or they say were looking into it. Its just like the airport when they do the random checks on people. Well in the immigration world we happen to be one of those people that got forgotten and screwed over. I'm afraid there is nothing that can be done as our fate is in their hands, and they are in no rush to even as much as look at our case. I booked my flight for Aruba for January 11th, and am preparing for life outside the US. Sadly this whole process is taking its toll on my fiance as she seems unsure whether its best to live in US or aruba, and she is done with the whole thing. Yes i was with her for 6 months but she was sad and depressed the whole time. Saying its nice having you here but sorry im sad i feel our life is on hold. I told her i hope she can hang on until i arrive in january and the way its been going i dont know i know i can but i dont know if she strong enough. Its getting to the point where us customs over in aruba is getting suspicious of me too they interrogated me and went thru my stuff since i had been there for 6 months asking what i was doing there if i was working they were looking for drugs they thought that i mightve been a drug dealer. Im starting to fear that they could ban me as well from aruba with all my coming and going since that is the only way we can see each other currently. Im definately on their list for sure over there nothing would make them happier then for them to tell me im restricted from coming to aruba as well. Well i hope you and your fiance situation is going well and not on our level i dont wish this on anyone. I just celebrated my 30th bday a few days along with my brothers who is deceased (2 days apart). I dont see any end in site in regards to getting rosy here. Even if its approved they can easily dissaprove us at the interview as they just did to her aunt who wanted a travel visa to the US to visit her daughter in Ny. They shot her down for wanting to visit her daughter look at us we trying to get married and im trying to bring her to the US they can easily just say no and go back to their lives and sleep comfortably on their pillows the same night.

@yalmonte sorry to hear about that it is such bs. Im not playing around im giving a call tmrw to USCIS. I fully expect an rfe, denial, or to be continually strung along like i have been, and they have absolutely no reason to do so.

Because its taking too long. On average the process takes between 6-7 months for approval its past 9 months now! The fact that my fiance who I'm petitioning for is restricted from coming into the US currently may have something to do with it. She was staying with me from October- December of last year in early December we left together and I brought my family as well to see hers for the first time. We stayed for a week and then upon going back to the US my fiance only had a one way ticket to the US. They stopped her and interrogated us for 4 hrs, then stated that she has plans to stay in the US that we planned to get married so she is restricted from coming to the US until she gets a CR-1 or K-1 visa. I told them if the one way flight is a problem ill purchase a flight now for her to come back they said no take a seat over there and took our passports. I believe in their eyes that I tried to sneak her in and marry her real quick which is why she is restricted amd that our relationship is a sham. Only thing i can think of as to why this is dragging out and taking so long. I expect an rfe or denial to justify why it is taking them so long.
