Hello,

its already 2/17 and last day of tax filling is April 15, can i still use 2013 tax return as current or fill 2014 tax as MFS and submit it?

help please.......

What is stopping you from filing your 2014 taxes? For all the US govt knows, you could have been unemployed from Jan 1, 2014 to December 31, 2014

No, because you aren't. You have to file a w-7 to get a tax id number for her. You have to file "married filing seperatly" or "married filing jointly". You don't have a choice of single because you are not.

Guess you're trying to get the id already. I don't know what you would do if April 15th comes and you don't have it yet. Best to request an extension I guess.

1) Why would you want to pay the US government more money than you are required to? 2) Married is married. 3) Do what is needed to get her a SSN whether that is using her unexpired I-94 or the EAD or GC to go to the SSA office and recieve the SSN. If filing as MFJ (Married filing jointly) benefits you then wait for her to get her SSN. If April rolls around and you are still waiting, I would file for an extension which gives you until October 15th to file your taxes, but you must pay any amount due by April 15th to avoid interest and penalties. You can also file as MFS (married filing sperately) which has the same tax benefits as filing single.

You use the last year's tax return you have as the most recent. If you have filed and the IRS has processed your 2014 taxes then that is your most recent. If you have not filed your 2014 taxes and file for an extension, you then have until October 15th to file 2014 taxes making 2013 taxes the most recent. If it is after April 15th you will need to show the USCIS the 2014 tax return or an extension. I would not waste time chasing down the ITIN as your spouse is eligible for a SSN. Just to be clear here. Taxes are under the IRS and you need to follow those rules and take advange of them to your benefit and not worry about the immigration side of taxes. The USCIS is requesting a copy of your taxes to prove inomce and to verify you are following the laws of the US because they cannot ask the IRS for them--you must provide them. Do what is necessary to comply with the IRS tax laws, but do not rush just to get one piece of evidence among several for the USCIS.

Yes you can but you need to file a 1040X as soon as you beneficiary gets their SS #

I did this in the past and it was not a problem...You have 2 years to do this.. They would enjoy keeping more of your money...But make sure you do the 1040X ASAP

no matter what time of the year it is when your beneficiary gets their SS # .......get the form at your local library during tax season...like NOW... Hope this helps.....
