Hello guys,

Just wanna ask this, cause these makes me confused..My bf is born in america and grown up there, so here's my question. The time I go sign up online in Cfo there are 4 questions, number 1 and and 4 makes me confused.

1. Is your fiance/spouse a foreign national ?yes or no? and i answered yes.

4. Do you have an immigrant/spouse/partner's visa?yes or no? and i answered yes.. because i already have my visa in hand..

So did i answered it right?

And one more thing I had my medical last october 9, 2014.. And when i got my visa today, I saw the information there that my visa is approved on feb 11,2015 and will expire on april 9, 2015. So how is that, Do i need to go U.S before my visa will expire and marry right after before it will expire and apply change of status? Or before the visa will expire i should have to go to the U.S?or before the visa will expire i have already applied chnage of status??thank you, hope you all enlighten me...GODBLESS..

The first half of your post requires a Philippines specific answer.

I can answer the second half of your post:

  • You must enter the US before April 9th
  • You have 90 days from the date you enter to get married, day one starts the day you set foot in the US.
  • Once you have entered the US, the expiration date on the visa is no longer relevant.
  • There is no written deadline as to when Adjustment of Status is to be applied for. However, the sooner you do it, the better.

You answered the questions correctly for scheduling your CFO appointment.

The visa is valid for 6 months from the date of the medical exam, NOT from the date of interview. You will need to travel to the US by the expiration in your visa, April 9. Once you arrive in the US, you will have 90 days to get married. As long as you marry within the 90 days, there is no set time limit on when to adjust status (although recommended to do it as soon as you are able).

I thought the visa is valid 6months from the date of the approval and not on the medical. Yeah, my medical would be 6 months this coming april 9, 2015 coz I had my medical last Oct.9,2014..Okay then so I really need to fly to U.S before my visa will expire. And marry within 90 days limit even my visa already expire?

The I-94 is no longer in paper form.

You can check it online after your arrival.

The only thing you need to hand in on your PoE is the big envelope.

The medical CD is yours to keep.

And the sheet that your medical I gave you I assume is your vaccinations checklist, if so. This is yours to use in your AOS package.

Your I-94 is available online after you arrive to the US. So no one will actually give one to you, just you will be the one to print it out from here: https://i94.cbp.dhs.gov/I94/request.html

The only thing you give to the officer at POE is the big yellow do-not-open envelope. The CD and the sheet (DS-3025) from St Lukes are yours to keep. The CD is like a souvenir as it is not needed for anything. The DS-3025 you NEED to keep that as you will send a copy of it with your AOS application.

You will get the certificate and sticker at the same time at the end of your CFO seminar.

Yes to both is correct.

The visa is good up to 6 months, the 6 month clock started with the date of the medical; this is the drawback of doing an early medical. You must enter the USA before the visa expires. Your visa will be invalid the second you clear POE, from that date your legal status is from the I-94 which is valid for 90 days - this is the time frame which you must complete your marriage. Once you are married within the 90 days you will become eligible to file AOS.
