"Most Recent Tax Year"

So would the "most recent tax year" be 2005 since we havn't filed in 2006 yet?? ?Thank you very much

Not true... We received an RFE and they asked for the 2006 tax return

I have never know USCIS to demand a document that the government does not require a citizen to file before the end filing date for that document.

Does your RFE specifically state "2006 income tax return"?

No it doesnt say 2006. But it says : Submit a completed and signed Form I-864..." and then it says " Federal income tax returns for the most recent tax year or certified Internal Revenue Services..." And we did sent the 3 most recent tax returns (2003, 2004, 2005 + W2's) and we still received a RFE

The tax return they are asking for is 2005, unless you've already filed your 2006 return. People still get RFEs even when they sent in everything. Did you include employment letters and pay stubs? If you did, then what you have to do is send everything listed on the RFE sheet again. Read previous posts about RFEs and see what other people have experienced to be sure.

i remember reading somewhere in the instructions that if you had not submitted your taxes yet for the prior year, to submit the returns for the most recent filed.

im surprosed the molinas got an rfe in january for it! my goodness.

however the molinas are in aos, your jsut a k1 right?

i wouldnt compare the petition to aos

aos is a more serious step and would be scrutinized more
