We received an RFE asking among other things for current proof of a shared water bill; we submitted proof of being on the same water bill at our previous residence.

We haven't been living together for the past year for mix of personal and professional reasons, although we've kept seeing each other and at one point planned to move in together again, things got in the way and our marriage almost fell apart. We're doing better now and started talking about finding a place together, but it doesn't seem like it'll happen before we need to reply to the RFE.

Currently my landlord pays the water bill. He knows we are legitimately married and has offered to sign an affidavit, but obviously couldn't state that we are living together. So what's the better option? Get an affidavit about the water bill stating we're legitimately married (not saying anything about us living together) or just stating neither of us pay for water?

Although I think we'd be OK, we definitely want to avoid the added stress of a second interview if possible :) (One lawyer I talked to said that legitimately married couples sometimes get rejected, not sure if that was fear mongering or not :wacko: )

If you guys don't sign the lease together, or you don't list your spouse on your lease, then there is no way the landlord can state you guys have been living together. Forget about the water bills, you can send other bills that have both your names on them. But since your spouse doesn't share your residence, there is no point in sending any bills unless you can fix the lease first. Nobody wants the hassle of the second interview, but in this case, it is very likely that you will be called to attend an interview for i-751 for failing to provide sufficient bona fide evidence of the on going marriage.
