Dear all,

I posted yesterday here that I sent in my AOS application (with applications for EAD and AP) but only got a NOA on the AOS application but not on the EAD or Ap one. I came here on a K1 and married my now husband within 90 days.

Anyways, we called the USCIS today and wanted to know why we only received one NOA for the Adjustment of Status but not for the EAD application and the AP application. They told us we would have to file an I-130 before the applications for those could be started?

I am lost ! Why do we suddenly need an I-130?? I thought we did everything right. filed for the K1, got the K1, married within 90 days and filed for AOS.

Anyone who knows?

Sounds like the operator did not understand your question and assumed you were adjusting from some other type of visa other than a K-visa.

The NOA for the AOS indicates that that has been received alright.

Did you send everything to the Chicago PO Box?

How long ago did you send the forms in? Your timeline lacks any information for that I can use to understand your case better.

I see on your other post how you said you sent them in Feb 1st. Seeing as that's only a few days ago I'd wait a little while longer since USCIS says to wait 30 days to receive any notices from them (although some have seen 14 days, either way you need to give it more time). If you haven't gotten the notices after 14/30 days I'd make an infopass appointment to have them resent. Upto you which guideline you want to choose (14 or 30 days) but I'd pick 30 to be safe and avoid driving to an infopass that may just tell you to wait a little longer.

You don't need to file I-130 anymore. Like you I also came on a K-1 & got married within 90 days. I received my NOA for AOS ahead. The NOA for my EAD came a day later in the mail. I don't think there's anything to worry about in your case. Just wait for the other NOA's and it will soon be there.

NOAs for each form come in seperate envelopes, and often on seperate days. Did you just get your first NOA in the mail? If so I would wait a week for the others to show up before going into panic mode.

Also: never ever call the misinformation hotline again: They talk shite. ;)
