Petitioning my Mom

I am a US Citizen by marriage and is now on the process of getting my Mom who has a 15 year old son, my youngest brother. I filed I-130 for my mom last year. I already paid for the Affidavit of Support and Immigration Visa Fees. Now that I am gathering my documentation prior officially filling-out the DS-260 I have a couple of questions, please. I really appreciate it if anyone can share any info about this:

1. Can my Mom take with him his minor child or do I have to file a separate petition for him? Who will be the petitioner then, and when?

2. How long it will take for my Mom to become a US citizen from date of entry to United States.

Hi,

1. He will not be able to immigration on the petition for mom. When a USC petitions for a parent, only that parent can get a visa.

You can file for your brother, it will take 13 years.

Once your mother becomes an LPR, she can file for him. It will take 2-3 years.

2. She will have to be an LPR for 5 years before she can apply for citizenship.

Thanks for replying me back.

So, as soon as my Mom get's her Green Card she can petition my minor sibling right? And Green Card will take 1-3 years you said, so my brother will be 18 year old then.

That means I don't have to wait for my Mom to become a citizen in order to petition my youngest sibling.

Make sure your mother maintains her LPR status. She cannot simply come to get her green card and then return home for 2-3 years.

LPR is Legal Permanent Residence right? Yeah, she's staying.

No need to wait for citizenship. She can file for her son as soon as she arrives in the US. She must bring her sons NSO birth certificate so she can file ASAP.
