I called NVC today and they said they would be requiring 2013 Fedral income tax return, IRS printout for my wife. I am super confused now. My wife she is living with me from past 2 years in India. So there is no way she can file the tax return. Also they told me your wife has to be one of the sponsor. But if she has not filed the tax, she is not having any income how can she be my sponsor.

I am not sure what to do now. As per the mail I have to resend the AOS document, shall I resubmit the same with my wife as joint sponsor and showing her zero income or send them a letter stating she is living with me here is India what to do.

Please help guys!

Thanks

Guys can someone explain meaning of 3 N/a?? one N/a shall be against AOS fees, another against IV fees. what does 3rd N/a stands for??

Btw congratulations to everyone who got CC...

Here's an excerpt from Saylin's NVC guide:

Case Complete

There's currently a way to know (not 100% guaranteed though) if you have case complete by looking on the CEAC site. If the AOS fee changes from PAID to N/A, then I'd suggest calling NVC up pronto as most, if not all, people who have reported seeing this have a case complete.

3 N/As usually means case complete.

Congrats to everyone who's getting cc and sorry to all those who got a check list. It is very unfair for us, January filers, that we are just sitting there and waiting while others who filed like 30 and even 40 days later are still waiting. Himanshu.7710, You are probably better to start a new thread rather than post here. I assume you are the applicant and your wife is the US citizen? The petitioner is the primary sponsor therefore your wife must submit an I864 even if she has no income ( I also assume you have a joint sponsor). As a USC she needs to show domicile in the USA (that she hasn't left the USA permanently), and filing tax returns would be an expected part of this, irrespective of income. Hope that helps but like I said, start a new thread of your own I think.

Hi freshairprince

Yes you are correct, I am the applicant and my wife is USC. Is it like USC has to fill up the tax even though he/she is not present in states for long term. In my case my wife is staying with me since marriage for last 2 years and she has not filed any taxes or has any think that can help her showing any domicile evidence.

I think I am in deep trouble and I am not sure how to ocme out of it :( :( :(

Hi himanshu,

There are few things that i feel you should check and do first before taking further action. First of all have you filled correct form?? There are various form for AOS, http://travel.state.gov/content/visas/english/immigrate/immigrant-process/documents/Step_4_Collect_Financial_Documents.html

Please follow this link to check if you have filled appropriate forms.

You will have to make sure that her income tax is filed (I dont know much about system in US, so ask someone who can guide it for the same) normally income tax statements along with paystubs (optional, but good proof of income) have to be submitted. In your case when she is not earning you might have to be sponsored by someone else along with your wife (she should be one of the sponsoror).

There are other docs which can be submitted with AOS specially if it joint sponsored. Please visit

Hi everyone,

Original scan date - January 8th (ugh). I FINALLY received a checklist last night. with the classic "checklist cover sheet".

I have actually already re-submitted my documents as I had called into the NVC and no checklist email arrived (it was -insert sarcastic tone- ONLY about 80 days after my original scan). My re-submitted documents are correct and correspond with the checklist - all is well. My new scan date is now March 18th.

Now my question is - the CHECKLIST cover sheet with the bar code is not the same as the original cover sheet (the bar code is there, the wording is just different) - will this kick my documents back AGAIN? Has anyone ever submitted their docs before the checklist email arrives?

Thanks...

People do it all the time (you're good)..some even send all their documents (AOS & supporting docs) with just the AOS cover letter. As long you have a cover letter w/ barcode then you are in the clear.

EDIT--

What was your 1st SD & CL date?
