Questions sponsoring in-laws on tourist visa

Hi All,

After 9 yrs of marriage and lots of hurdles, finally we are expecting our first baby and we are organizing a part here in US. My wants her parents (who are in India) to be part of this occasion. My wife got her citizenship based on marriage with me but she hasn’t worked in US so far ( no income last few yrs).

  1. Is it ok to apply visa for her whole family in india ( parents, 1 sister (26), 1 brother (19)) or should apply for only few members ?
  2. Should I sponsor them or my wife needs to sponsor, while I can show financial support on the application ?
  3. Usually for this sort of reason, it is easy to get visa ?. What can really improve chances of getting visa & what can hinder the chances ?.
  4. When her parents should apply for visa if they want to come here in May 2015

Thanks

- Riya

Hi,

First of all, congratulations on the great news. Yes it is ok for you to co-sponsor the visa application for your wife's family along with your wife as long as you meet the income requirements for the sponsorship. Another option would be for her parents to self sponsor themselves and their children.

You should file the visa right away because it takes anytime from 2-4 months to get a visitors visa to the US from India.

The approval rate for a visitor's visa depends on how well they can justify their ties to their home country and their intention to return back to India before the end of the visa period (eg, ownership of property, dependent family, steady job/income, ongoing studies, bank balance, etc.).

All the best.

There is no sponsoring for a visitor visa.

There is no sponsoring for a visitor visa.

Atleast at the Indian consulates, an applicant applying for a visitors visa to the United States needs to show proof of their ability to sustain and support themselves during their stay in the United States which includes sponsorship by a US citizen relative.

Note: Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a nonimmigrant tourist visa. If you do choose to bring a letter of invitation or Affidavit of Support to your interview, please remember that it is not one of the factors that we use in determining whether to issue or deny a nonimmigrant tourist visa.

Agreed.

And as I wrote in my first reply (kindly refer to my first post), the approval rate depends on the applicant's ability to prove their intent to return to the home country before the end of the visa period.

I believe this clarifies.

You stated that there was co-sponsoring of the visitor visa. That is not true. There is no such thing as sponsoring a visitor visa.

I did not say anything about overcoming the presumption of immigrant intent.
