No income tax forms for Sari Sari

Timeline

My fiance' works at a small sari sari, that is in her sisters name ( at their house , of course). When I filled out a sample DS160 for her, I said that she was a small business owner of sari sari. So when My fiance' filled out the DS160 on-line she just copied what I put down. Now that ask her to bring in her latest Income tax forms to her interview. Her sister doesn't even file income tax - very small store. My fiance' is afraid she will be rejected for no income tax forms. I told her that they really want MY income tax forms, not hers. I sent my last 3 years to her as part of the I-134 package. Am I wrong?

Yes, they only need your income tax not hers. My fiance (now husband) also sent me his last recent pay stubs, employer letter stating his position and salary, and stuff like that.

yes only the U.S petitioners income matters. It is their tax forms that is needed

You are correct, the embassy wants YOUR most recent tax return and W2 (NOT 3 years), they don't want her income tax return.

Strong possibility the embassy won't even ask for yours, since the new instructions letter came out many are reporting back that they were not asked for the I-134 and tax return.

Timeline

Sari-sari store owners are categorize as marginal income earners (gross receipts < 100,000 per year) and they are exempted in paying income tax...until last year when BIR decided to lift this exemption so they can "increase" tax collections. So she should file for tax returns for 2014...but I know a senator had a file a counter-bill to put this exemption back in place. Let's wait and see...

And lastly, the USEM won't look at the beneficiary' s income tax...it's the petitioner's ability to support the beneficiary that matters.
