Hello VJ group!

My fiance and I are in the process of completing the DS-160 to prepare for his medical and interview down in London. One of the questions in the DS-160 application asks the following: "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?" We're unsure if the answer would be yes or no since he once was involved with another American citizen about 4 years ago and he can't recall if she did file anything. He never received a notice and if she had filed it was without his consent. We don't want to be misleading so would it be okay to just answer no?

He also had what we in America call a DUI, years ago and it's on his police record which he has to take to the medical. Would this be something that he would have to say yes to this question: " Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?"

He would know if somebody file a petition because he would have had to supply a signed G-325A and a statement, and a passport photo. If he did that then best to say yes. She couldn't file without his participation. Maybe he just doesn't want to talk about it.

Yes, of course he has been arrested or convicted. Even if he got what they call a caution, he has to say yes.

Thanks Nich-Nich! He says no, but if he is mistaken, could this or his "DUI" conviction be an issue for the visa?

I don't think so.

If he says he has ever tried drugs, even once years ago, they will do a drug test. They will ask him probably.
