cr-1 visa denial plz help

Hello

My priority date was Aug 03 2013.i had my interview in Accra-Ghana on 9th of feb 2015.after a short question and answer session.the CO Without looking through my photo album ask me to wait.he was going to call me back.he called me back.handed to me my photo album and birth cert and marriage certificate but told me he was going to keep my call log and whatsapp messages as well as viber as evidence.he then told me after going through my things, he doesn't find it credible.that he is going to send the case back to u.s.a.I ask him why not credible.he told me he cant give me the reason and that my wife will be contacted with the reason.

Please what do i do now and how long before they send it back to u.s.a.Any help will greatly be appreciated.thank you in advance

My husband and I are also going through the same thing...believe it or not, it has become quite common. Our file was sent back June 15, 2014...we received a Notice of Intent to Revoke on October 4...we returned our evidence on November 4...as of right now, we have heard nothing....it is a very long wait. :(

Didn't I say his case was AP'd not denied? SMH Wrong info always get people messed up......

OP......as I have been saying all along. Since your case was AP'D all you can do at this point is wait it out. Start gathering Affidavits of people who can attest that they believe your marriage is "bona fide." Important Affidavit's you want to get those notarized w/stamp from a notary. Also include a photo of that person, name and address, You want that person that can genuinely say that they have seen the two of you together and you both appear to be very much in love. If cancelling and starting over were an option, could you really go another year through this hectic process? That's more stress on the heart, besides they won't let you do it anyway, there is a paper trail. So your best bet is to spend a lot of time together, encouraging each other and building your marriage because this AP thing is really hard on a already stressed marriage. Start acting as a couple that is together {as much as possible}. You want proof positive that you two are in love and not trying to usurp immigration. Reread all my previous posts because this one just adds to the rest.

The CEAC website seems to use AP as a catchall term (people have had visas approved and subsequently issued see that same phrase while waiting to get their passport back {status does changed to issued in this instance, however, I can't speak to if the status changes to refused or not}).

What does the 221g form say what is being done with the case. If a CO does not believe a relationship is genuine, they will deny a visa under the 221g provision of the INA and send the case back. If the form you have in hand mentions in any way that the file is being returned to the US and not remaining in the country, then this is a visa refusal and not Administrative Processing.

To answer your question, withdraw and refilling won't change the circumstances doing that is not a good idea IMO.

If your file is in fact being returned to the US, then there is a greater than 50% chance that an NOIR will be issued. Obtain the letters has others have suggested, just realize that there is no one here can guarantee that they will ultimately be useful. It will depend on what points are in the NOIR if and when one is issued.

The OP has stated very clearly, above and in his thread's Subject line, that the visa was refused and that the file is being sent back to USCIS.

Anyone who continues to post gross misinformation -- in the face of repeated clarifications from reputable VJ members who have encountered this situation over and over -- might need to have their continued participation in this thread re-evaluated.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
