This is a K-1 Visa and met the requirements and so on. She has her Permanent Residence here in the US and will abide now to US dissolution of marriage guildlines and the Philippines has no oversee of that. She can report it but has no intention but to find another here in the US. It wouldn't matter anyway. She is free to travel if she pleases. Why Complicate things. It is treated like a Normal Divorce here in the US and they were Married here in the US. (therefore, US law.)

The op ask specific about his wife status in the Philippines.. Please read the whole question before responding with an half answer .If his only concern was of her living in the USA and remarrying, Then they could get a normal divorce. However unlike you,I read the whole post and seen the Op other concern,about his wife status, in the Philippines, which means he has to file the divorce in the USA.

Just wanted to say that if you have only been married for two years, her green card is a Conditional Resident Card for 2 years not 10 years.

Help,

It appears that myself and wife are not going to be able to work things out! We have been married just over 2 years and she has received her 10 year GC, my question is since is still a filipina citizen how does this affect her status in phillipines? This is a very amicable divorce and I want to help her (she is much younger than me) and I want her to be able to remarry an american and have a family kids etc, and I am just to old for that.....She did send our marriage paperwork to the phillipines last year, so they do know about the marriage, so if we get divorced here is that recognized in the PI? How can we get our marriage dissolved in the PI so she can remarry here?

have you removed conditions on the original 2 year green card already? If not she does not have a 10 year green card yet

Thank everybody for the great answers and yes it is only the 2 yar Green Card because of the long wait time to get the green card after we were married! (6 months) So she will get her permanent 10 year green card in July of this year (I plan on staying together till then)

I think j&ana make some very good points. And over all, their answers are correct, in my opinion.

One thing, I would point out, is of course, there is no such thing as divorce in the Philippines.

Also, adultery, not even bigotry will get you what is called an "annulment!"

The ONLY way, to get an annulment in the Philippines, is either the man or the woman, must be proven to ,""not be or sound mind at the time of the marriage,"" that is the only way.

Been there done that!

Also, the man must file for divorce here in the USA, for the woman, to have the divorce recognized in the Philippines.

It is sad things like this happens, but it would seem we have two very mature, good hearted people, working out a difficult situation. Don't we wish all separations, and divorces would have each others wants and needs taken into consideration.

It would be a better world. Here in the USA, maybe 1% end with both willing to work things out, to each ones advantage.

Actually if she remarried without dissolving the marriage in the Philippines the charge would be bigomy, not adultery.

From what I have seen they would more likely charge her with adultery

My best friend who is married was caught boom booming a married chick in Philippines, he was charged with adultery and was able to payoff the charges via cash...........

yes that is adultery when a married person Is boom booming someone other then the person he or she is married too. It will be bigamy if two people married and one or both of them is already married. In your friends case that was adultery. However if the op wife gets remarried and is not consider divorce in the Philippines, then that will be consider bigamy

I see a lot of misinformation in this thread. Hmmm...where to start...

If the U.S. citizen initiated the divorce, the Filipina could get remarried outside of the Philippines without any problem. The chances that she would be charged with bigamy while in the Philippines is minuscule. If she wanted to get remarried in the Philippines, she would need to have a Filipino court recognize the foreign divorce.

If the Filipina initiated the divorce, she could get remarried outside of the Philippines without any problem. Again, the chances of getting charged with bigamy while in the Philippines is minuscule. If the Filipina wanted to get remarried in the Philippines, she would have to get an annulment first.

Divorce in the Philippines is allowed for Muslims.

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
