How long can you wait to apply for AOS on a K1 Visa?

Just curious regarding how long you can wait to apply for AOS on a K1 Visa? We are getting married in March and 90 days are up in April.....

As soon as you have your marriage certificate.

That must be sent with your AOS application.

You do not have to apply within 90 days, if you pass 90 days you will be out of status but it is forgiven once applied for AOS.

You will be back in status when you have your noa1 which if needed is proof of status.

It's always best not to wait too long, I wanted 3 months after I married until I applied which was 4 months after I arrived.

We were married in June and I waited until August 1...the K1 expired August 7. There were no problems with waiting until the expiration. Some states take quite a while to process marriage licenses, so there's not usually an issue with delaying it a bit.

Just to clarify. The k1 visa expires the moment you enter the states. It is a one time entry visa.

The 90 days you are given is just lawful presence to get married within a set time.

You can apply for AOS after the I-94 expiration date.
