Hello,

My wife (the USC) and I filled the I-130 petition and put Question C 22 as N/A since I read the whole section to be only applying to people inside the US and applying for AOS (I am not). Is this something I need to worry about now? I had read that if my address (the beneficiary) was outside the US, the answer should be N/A. I am now reading that if we put N/A to both then I might have to file another form (I-8something...can't find it now) to get my case routed to the NVC and that it would take more time and cost more.

If I put both questions as N/A is this going to cause an issue? What should I do now? I am a bit panicked to be honest...the petition will take long enough and now if I messed up....well that would be terrible.

So am I ok with both being N/A? Do I need to do something to try and fix it? I mean we sent it already and have our receipt number...so not sure what could be done.

The question is really badly written.

2015-06-26: USCIS update that case was sent to NVC

2015-08-26: Pay IV Fee

2015-09-05: Submit DS-260

2015-09-07: Sent AOS and IV package via EP

2015-10-11: Resubmit via EP after being told to do so on 2015-10-09 as it looked like our original emails were lost

2015-10-16: Received email for scan date of 2015-10-12. Told that basically nothing can be done and we need to wait 30 days from 2015-10-12 (30+ days lost because they lost our emails)

2015-10-26: Told case is basically complete but that they are building my electronic file. Told there is no timeline for this.

2015-10-30 & 2015-11-13: Still told no update. Building electronic file still and no timeline.

2015-11-17: Case Complete

2015-12-03: Receive packet 4

2015-12-15: Medical

2015-12-18: Medical picked up results

2016-01-12: Interview - Approved!

2016-02-03: POE

Have the NVC responded yet? Have you tried calling them to clarify? I agree it is a poorly phrased question, anyone could have overlooked it. But I read online that it is meant for people who are adjusting for status while in the US and if that doesn't work then for processing further they'd have to mention that info so they can go through consular filing like the rest of us.

I think you will be fine if you are in Canada and your address is Canadian address. They will select Montreal (only one place that handles immigration visas at US consulate is Montreal).
