I am US citizen and I am applying for both my parents.

Currently I am on the Affidavit of support stage.

I am married and for all recent years we filled our taxes together with my wife. Can I still use I-864EZ form?

I have this question because in this form I am saying that I am going to use only my personal income. But if I am going to show OUR Federal tax returns (1040EZ) for recent years it`s not really only my personal income.

What do you think? If there is the topic related to this one, please just give me the link.

Yes you can file I-864EZ

1. As you file for your parents on separate I-130 applications, you do not have derivatives. So no-derivatives test is passed.

2. You should be able to substantiate your income with W2/1099. It should pass poverty threshold etc.

Yes you can file I-864EZ

If you know, could you help me with following ones too. Than more I go to details, more questions I have.

Do I need to attach my W2/1099 or transcripts from IRS for all 3 my recent years or one year is enough? As I see there is a choice in the form, but...

In the form I-864 on the page 3 (Part 5. Field 19th) there are TWO check boxes. And if I select first, it automatically selects second one too. If I select second one, it selects first one. So as I understand, the form REQUIRES information for last THREE YEARS anyway. Am I correct?

One more thing. Do I need to attach:

- a) ONLY my W2 forms (we filed our taxes together with my wife, so it will show my personal earnings),

or

- b) ONLY transcripts (but they show, as I understand, our joint income)

or

- c) ONLY 1040EZs,

or

- d) all of them just in case?

I am going to have 2 visa applications (for mother and father), so for both of them I have Household size - 3 (me, my wife and one of my parents in both applications). Correct?

If you completed Form I-864, I-864A, or I-864EZ and the income reported on this form or your tax return reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. This can include the following documents:

  • For those who are employed by an individual or company, submit a photocopy of an employment letter, pay stub, or pay advance (direct-deposit receipt) that meets the criteria below:
    • Includes your name and the company’s name;
    • Is on signed, business letterhead (you cannot sign the letter yourself); and
    • Is issued within the last three months.

What DO I need to submit if it`s not BELOW? Because I think that instructions don`t require to submit pay stubs etc if Transcripts or W2 are ABOVE the poverty guidelines for certain year.

Did you by chance find out the right way to do this? Or how did you do it? because my income is not below either and that Pay stubs are not required either according to the instructions for I-864 EZ that I am reading now in 2019. Thank you
