Interview for I-130 petitioner while spouse overseas

Guys, I got my wifes I-130 approved yesterday and the status changed online to approved.

Questions asked about first marriage

It was a short marriage what happened

Where was she from?

Who introduced the two of you? My mom.

How did your mom know about her? Through a matchmaker

when did you move here?

where is she now?

did she remarry?

do any of you have kids?

where did she live with?

when did she move in with you, when did she move out?

she was asking questions really fast trying to confuse me with dates but I was calm and corrected with the dates and places

Questions about current marriage

where did you meet her

did she have an issue with you being divorced

what do you guys have together

i mentioned i am planning about next trip, she asked where, i said istanbul

I gave her all the evidence of currrent marriage, then I mentioned they should

have given you my I-751 evidence. I said looks like they didnt, I took out

copies of all evidence for I-751. The second piece of evidence was my current

pay stubs and my approved I-140. At this point she said she will approve the

case and forward it.

She explained to me that in I-751 its by preponderance of evidence they determine if the marriage was real. In cases where one files for second wife when he received green card through first marriage, one has to prove via CLEAR and CONVINCING evidence that first marriage is real and so is the second one.

She also said for cases such as mine, the bar is set much higher.

I would still say you did the right thing by filing your case. I don't think it is worth it, to wait 5 years for marriage because of USCIS. USCIS has recently gotten more strict when dealing with immigration related benefits for foreign nationals, they are highly reluctant to give out green cards.

I didnt like the way I was questioned for my currents wifes I-130, I felt as if I was a criminal and had to defend myself. I have put my green card and immigration related paperwork away in the closet. I did it so it wont remind of the bad experience.

Anyways, we all learn something from our experience. Just bear in mind, you have everyones support & sympathy for your pending case.

Gonna try to make this short: Ok so i became LPR in April 2010 (conditional 2 years) through USC. July 2013 i received my 10 GC after interview. Our marriage was just not working and he cheated told me he found someone else and divorced me. He has a kid already with the other woman. By feb 2014 our divorce was finalized. However by July i went to my home country and married my current husband now i kinda wish i had waited since i hadn't done any research. But i didn't think i would have to wait and that there was a five year rule. I love my new husband and I'm so ready to move on from all the hurt and pain my ex caused me. My current husband helped me to heal.

Anyways we got married on July 12th 2014 I came back to us and filed for him on the 26th of July 2014. In december they transfered my case to boston local office. Went to info pass twice. first lady claimed she didnt know why case was transferred. 2nd time lady told was because it was because of the five year rule. I still havent gotten an interview or any kind of information from this local office yet. I a little worried because im not sure i have alot of evince for my first marriage never knew i needed to keep all that stuff. I will work on trying to recreate any joint documents we had together.

Also to add to the mix i have an interview in about a week for naturalization. I am little worried as to questions they may ask and if they may deny me citizenship base on divorcing remarrying and filing for someone else. Wondering if the local office is waiting for my naturalization interview before they ask me to come to an interview pertaining to my husband....

The thing is, USCIS is just step one. Your spouses will have to convince the consul at their embassy interview that the marriage is really bonafide (your past and them as current). The consul has the final say so there's still so much you have to prove. USCIS approving the i130 doesn't guarantee the visa.

Once the local field office receives your case, they have 90 days to schedule the interview. I assume you are still under 90 day window after your case got transferred.

Having naturalization interview is a good thing. I wouldnt be too concerned about this, they will ask you basic questions and ask you for your divorce certificate regarding previous marriage. Lets clear this naturalization interview then worry about the I-130. There are plenty of people who had I-751 good faith waiver and later became citizens. You will plenty of experience on this forum as well.

Best of luck for your naturalization interview, prepare for it by going through that little book they give you. Please do share that experience as well.

Thanks for remembering me.

No update yet. i would have thought that i would have gotten an interview by now since the case got transferred last december. My N400 interview is tomorrow. I am convince that they are waiting for that before going forward with anything. Will see how my interview goes tomorrow I'm sure they are going to ask me questions about both marriages.

So I just passed my interview for naturalization. I was only asked the questions on my application and did civics test pretty simple interview. The io was very nice. At the end of it all she told me that she actually also have my husband's case in her hand but that she does not know what they will do if I will come for interview for it of if they will deny it she doesn't know but it is good that I am getting my citizenship. This will help speed things up she says and that it is best if they hold on until after I get my naturalization certificate.

Actually I didn't. She was the one that brought up the fact that she also had that case with her after she approved me. I was in her office for about 20 mins pretty easy straight forward interview. After she told me she also had that case in front her I told her I was worried because I haven't heard anything since December she said that it is taking long because I got divorced remarried filed for spouse within 5 year and that's why it was taking long. She said she has no idea what they are going to do about and I said to her I guess I have to wait some more and see and she said that it's better if they hold off until I get my citizenship. So I'm gonna atleast wait until after I get, upgrade the case and she what happens. She seemed very nice and she said that's he knows I want to be with my husband and she didn't seem judgmental. Any updates on the I-130 case? I am in the same boat. I got my temporary green card on 2010 and 10 year card at the end of 2012. I have divorced with my USC spouse on March 2014 and married to my current wife on June 2015 who is back home at the moment. I have filled for her I-130 on September 2015, My case was transferred to local office on Feb 2015. I received the I-130 initial interview on June 11 which is cancelled because of the conflicting schedule with my Fingerprint appointment on June 10, 2015 (For naturalization). Can you please mention if you hear anything regarding about the I-130? I was planning to go for the infopass appointment but I am planning to stay quite until I got my Citizenship or until they reschedule my interview. Thanks

Prepare for them to ask you questions about your divorcing and remarrying. My io didn't ask but there is a possibility that yours might. Also I have no information on my I-130 I'm just here waiting and losing my mind. I'm waiting for my oath ceremony which seems to be taking forever too so that I can upgrade my case. Info pass is a waste of time. Especially since they already scheduled you for an interview. Wait for the reschedule interview. Because they are only gonna tell you that they usually interview people who got remarried within the 5 years of being a permanent resident through marriage. I did 2 info pass because they had yet to schedule an interview since they transferred my case in December. And that didn't really help me so i'm just basically waiting for my oath ceremony so I can upgrade the case. ?
