Interview for I-130 petitioner while spouse overseas

Hello everyone-

I initially got my conditional green card through marriage to USC on June 2011. I was divorced in August 2012. I got my 10 year green card in February 2014 through filing I-751 for good faith marriage.I remarried in May 2014 overseas, I filed for her in July 2014. I got an interview date for February 25 at my local USCIS office.

I was under the impression that I-130 gets adjudicated in service center and the case goes overseas while date is current. However its changing now and petitioners for stand-alone I-130 are facing interviews.

Anyone in the same boat or similar, please share.

Interviews at the USCIS level for standalone I-130s are extremely rare, and tend to only happen when there is a problem, such as suspected fraud, possible AWA-related issues, or other things that would prevent a straightforward approval.

The ones I have seen is where marriage occurs during deportation proceedings.

i would agree i've heard of one other case where the petitioner got his green card from a previous marriage, divorce then remarried/refiled soon after.

Can you please share more information about the other case where they interviewed the petitioner on his or her I-130?

On a personal level I am 35 years old, my first marriage didnt work out and I was on the look out right after we got separated. Thank God I found someone who I can have kids with and spend the rest of my life. I am much happier now, than I was in my previous marriage.

I think you're not qualified to file i130. Its been less than 5 years since your 1st marriage to your USC spouse and you filed for your new spouse.

You can try to squeak through under "B", but "clear and convincing evidence" = a lot of proof of bona fide marriage is required.

This is probably the source of your problem. At the interview they will want you to show more proof of bona fide marriage than the average applicant. If you couldn't show such proof then your I-130 would be denied.

Thanks a lot for posting. I cant believe I missed that info, I guess I never looked at who cannot file since I assumed I always can.

I will take all the documents regarding i-751 for good faith marriage plus evidence for my current marriage.

I recently received a long email from my ex-wife apologizing to me. She states she has been very, cruel, and rude and asks for forgiveness.

I replied to her and forgave her. It a little emotional and I dont wanna present this as extra evidence during the interview.

What do you guys think? I wanna try to avoid showing unless its absolutely necessary.

Yes I did marry from my home country Pakistan. After the mess I was in last time, I made a promise that I will never a marry a USC ever in my life.

The emotional mess plus the scrutiny that USCIS puts you through, I decided its not worth it,,

You do realize that USCIS will put you and your new bride under very heavy scrutiny right?

If it's not worth it, then why go through it again by petitioning for her?

I have known my current wife for almost two years and its not an arranged marriage. I found her by myself, soon after my separation from my first wife, I started looking and I found her, thank God.

I didnt realize at the time that I will be scrutinized but I do now which I will deal with. For my current, I have lot of evidence because both of us are in touch almost the entire day through whatsapp and talk almost 2 or 3 times a day.
