Affidavit of Support question

Hi all,

Apologies if this has been answered numerous times I've looked in many areas and become slightly confused.

My wife earns below the poverty level to sponsor me due to it being a 4 person household including me (wife, her 2 kids, and myself). Looking at co sponsors the first choice will be her mother who earns roughly $20k from a combination of social security and pension. I believe we have to go off purely her taxible income as at this point I'm not sure if social funding will count. The other option is my wife's brother who lives with her mother and joint they would have more than enough between them (her brother isn't included as a dependant on her mothers tax) has lived with her for over 6 months. I'm guessing I'm a bit confused on the whole co sponsor thing and wondered if what I've wrote sounds about right!

Thanks

Mike

Gross Social Security and pension count. Obtain a statement from the pension department stating yearly amount. She gets a statement from Social Security each December saying what her new yearly benefits will be. Those are used like employment letters are for working people. Her household size is 2 (her +you).

Because her brother lives at the same address, she can pool her income with his. She would have to count him in her household size (Part 5, #7) making a household size of 3 and the resulting higher required income level. His information and income are Part 6, Person 1, 6abc. He would complete form I-864A to indicate he is allowing her to use his income toward support of an immigrant and share the responsibility of being a sponsor.

It's explained in the form instructions.

Your wife's brother earns more than her mom, right? They also live together. Then I would suggest her brother as the joint sponsor. Her mom can be included as a household member of her brother. The forms should be filled up in the following way,

Your wife: Sponsor, form I864

Your wife's brother: Joint sponsor, A separate I864

Your wife's mom: Household member of joint sponsor, fOrm I864A

You have to prove the relationship between her mother and brother. A birth certificate of her brother will do that.
