bad aos interview need advise

Well, the signs of so many answers that were varying in the degree of difficulty, the big one stands out, how could you miss the wedding date? That is a huge problem.

You may get a second chance, but right now I would say it is 50/50 as to whether or not you are approved.

But, I believe you, as you seem very honest, and forthcoming, Good Luck in the future!

Me and my wife had initial AOS interview yesterday , i'm Vietnames came here 5 years a go with F-1 Visa and my wife is white. the Interview when really bad, the IO seperate us right away. He called my wife first and after 40 minute he called me and interviewed for 20 - 30 minute and he called my wife again saying that he think our case is a fake marriage and convinced my wife to accept it, but of course she didn't. he ask us about 40 - 50 questions, and we have 4 mismatch.

IO : where did u guys have *** birthday together ? with who ?

me: at ****, with kids

her: at **** place, with kids and her family

IO: what did you guys do on chirstmas

me: celebrate at home

her: went to grandma house

IO: when did you guys move in together

me: we stay with my cousin family after marriage and move to *** on xxxx

her: we move to *** on xxxx

IO: wedding day?

me: 2/12

her: 2/11

our evidence including : 10 photos with her, her son, me and family. tax return together last year, 8 months bank statement with our name, car title, aparment lease. Can you tell me what do you think about our case and will they just deny us or they will give a second chance.

P/S : she work until from 10 pm to 8 am on the morning , and our interview at 9:20, so she answer a lot of wrong questions

Not knowing your wedding day is one of the biggest red flags. Get ready for a possible second interview where they will video record you and ask you even more questions. Also get ready for a possible surprise visit from USCIS, officers will come to your house, take pictures, ask you guys more questions, even talk to your neighbors. Then you will have to wait for a response where you will either get an approval or a NOID ( Notice Of Intent to Deny).

I suggest you get a lawyer if you get a second interview or if you get a NOID, and prepare as well as you can.

Speaking as someone who has previously worked nights I can tell you that it's a very very VERY bad idea to do anything important straight after a night shift. But you've realised that the hard way now. Working a night shift is 10 times harder than working a super busy day shift. Working nights causes chaos in the body and the brain because the human body is created to sleep when it's dark and be awake when the sun is up.

If you get a second chance, make sure your wife is off the night before or get an interview in the afternoon so she can sleep a little. If you get denied, I would appeal on the basis of your wife going straight from a night shift to the interview. There is soooooo much research on the dangers of working night shift on a regular basis. Working nights have been linked to a variety of illnesses such as heart disease, cancer and mind diseases such as Alzheimer's. Google all that research and put that as proof that your wife was basically out of her mind at the interview. There's specifically a very thorough Danish research done on this which actually prompted the Danish government to implement regulations on how long and often people are allowed to work nights. Just google dangers of working night shift and you'll get a ton of evidence that your wife was not herself at the time of the interview due to her coming straight from a night shift.

So that's why I was asking if you had even had your biometrics, had gotten EAD or AP, etc.

No, in my case, NOA2 is approval of the I-130 petition my husband sent to USCIS to get approval for me to be allowed to apply for a spousal visa. I'm still in Sweden and my husband's in the US, we are doing the spousal visa CR/IR1. We're just at the first stage right now. ?

And i think all the mismatches can be explained.

Just have another question, if USCIS goes to our house, but they only see me or my wife in there , will it raise any red flag ? ( my wife work from 10 pm to 8 am, i work from 8:30 am to 6 pm)

Physically present--no. Not having clothing or other personal items woud be a huge red flag. There must be evidence that the two of you live in the same house. Also tell them to come after 6 pm but before 10 pm if they want to see the two of you together.

I doubt you can 'tell' them when to come.

The whole idea is a surprise visit; as I understand it.
