Me and my wife had initial AOS interview yesterday , i'm Vietnames came here 5 years a go with F-1 Visa and my wife is white. the Interview when really bad, the IO seperate us right away. He called my wife first and after 40 minute he called me and interviewed for 20 - 30 minute and he called my wife again saying that he think our case is a fake marriage and convinced my wife to accept it, but of course she didn't. he ask us about 40 - 50 questions, and we have 4 mismatch.

IO : where did u guys have *** birthday together ? with who ?

me: at ****, with kids

her: at **** place, with kids and her family

IO: what did you guys do on chirstmas

me: celebrate at home

her: went to grandma house

IO: when did you guys move in together

me: we stay with my cousin family after marriage and move to *** on xxxx

her: we move to *** on xxxx

IO: wedding day?

me: 2/12

her: 2/11

our evidence including : 10 photos with her, her son, me and family. tax return together last year, 8 months bank statement with our name, car title, aparment lease. Can you tell me what do you think about our case and will they just deny us or they will give a second chance.

P/S : she work until from 10 pm to 8 am on the morning , and our interview at 9:20, so she answer a lot of wrong questions

she was unemployment before marrying me. but we have joint-sponsor and she's having a job now.

everything else is normal. ( no marriage history, i'm still in legal status...)

How do both of you meet? Age difference?


You have family members in US. She is unemployed, with a kid

You were both living with your cousin family after marriage.

Is your co-sponsor from your family too?


Both of you don't know who you spent birthday / Christmas with, a red flag.


USCIS might think you are paying her for green card.

I totally agree.

How can you miss your wedding day? That's a major life event and will definitely raise a red flag with USCIS.

I am certain there are always a few questions which are hard to answer, but if you have major events and you are not able to answer them, then this is very suspicious and will raise concern.

In case you are denied and if your marriage is serious and real, then you should speak to a lawyer.

Do you think they will give us second interview ?, because we didn't prepare for this one since we were confident. The reason we have so many errors because my wife didn't sleep last night.

Not sure about a second interview. You should wait for the decision and in case appeal.

Personally, I am not sure what to "prepare". Because if you have been together long enough, you should know and be able to answer simple questions like your wedding date.

People can miss a wedding date by a day, especially if it was a

quick civil marriage that required very little planning and quick execution.

Though its not good, but I don't see that as a big red flag.

Also the minor difference answers are still correct,

it's just that one is longer and the other is shorter.

Also, they could have told her the "fake marriage" thing,

just to see her reaction.

If they told me the marriage seems to be fraud,

I would have asked WHY? WHY? WHY?

And also I would have asked what evidence you can provide to clear that.

I've seen other posting like this on VJ site where they thought the interview went terribly bad

but they got approved.

I guess at this point, only thing you can do is wait...

Hi, I had my interview in Milwaukee last week and generally speaking it is not a difficult office. The fact that you were separated right at the beginning means your file was flagged as a potential fraud case. Is there a big age difference or educational difference? Are your careers glaringly different? All those put together may lead to a suspicion of marriage fraud. You will have to wait a few days to hear from them, that letter will let you know if there will be a potential 2nd interview, approval or denial. Hang in there.

All I can say is if youhave another interview, have your wife take off work so she is properly rested. I understand how lack of sleep can affect your ability to remember facts as I took the DL test after a long night and failed. When I retook the test after plenty of rest I got 100%. So I can see how your wife made errors.

Hopefully you will either get an approval or a second interview.
