Bonjour!

In october our first file got rejected and sent back to us because we made a mistake with the filing fee.

With that rejection we received a Notice of Action Form I-797C with a receipt number.

At the end of October we refiled the same file but with the correct fees.

And since we have filed we have not received any notice back.

Our two questions are :

  1. Will we have the same receipt number for the second file or will we be issued a new receipt number?
  2. We are thinking about refiling again but our fear is if they did received our last file and they have just been really slow in responding with NOA1 (we filed with the texas office, and we have heard that they are slower with responce times) that refiling again may cause a problem. However it has been 3 months and we have not received an NOA1 by mail or email

The check we sent we have no way of knowing whether or not it was cashed unfortunatly. And as for the electronic notification form yes we did submit that with the K1 application and have not gotten an email from them yet.

Also we have check our old receipt status and all is says was that our form was denied due to insufficient funds. But that is in reference to the first package we sent. And it doesn't say anything about our second package, whether or not it was received. We've given them a call and given them our receipt number, but they said the same thing. That our first package was returned due to the wrong funds, and they didn't have any info on our second package. However they said that sometimes new receipt numbers are issued when a refiling happens.

Thank you for the help so far everyone. We hope to get this resolved soon!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

How did you get a receipt for something you didn't technically pay for (the first filing attempt)? The easiest way would be to take that receipt number, check it on MyUSCIS, and see if the information (such as the date received) matches up with the first or second filing. If that doesn't clear up your doubts, then call the NCSC and try to figure it out with them.

You can't tell if the money was taken out of the account or not??

Also, to clarify, you didn't send your file to the texas service center. You sent it to the lockbox, which happens to also be located in Texas. They are two different facilities.

No we can't tell if the money was taken out of the account or not. And yes it was sent to the lockbox. Thank you for clarifying.

Also the way we got the receipt number for the first file was when they sent back the K1 visa package there was a letter of rejection for not including the right amount of money, for we found the info on an old site with the incorrect amount of money on it. But with the rejection there was a receipt number. We've checked that receipt number on the website and it only says that the file was sent back to do incorrect funds and doesn't mention anything about the second file. And we've read that sometimes that a new receipt number is issued when you resubmit your file. We've tried calling them but we've been unsuccessful in getting any help thus far from them. Although we are continuing to try through the phone service.

I can really only think of 2 suggestions. First place to start is to email lockbox support at lockboxsupport@uscis.dhs.gov

I'd email them since the problem seems to be the intake of your petition. Explain the entire situation and that you resubmitted the petition with the correct fee as instructed.

Second, can you call the bank or go down there and make them give you a statement so you can see if they took the money out?

What I just do not understand is, "why can you not tell if the filing fee has been taken, from a bank account, or money order (go to post office, check the copy with the USPS) it is a mystery to me, why you cannot tell if the, I believe, 340.00 is been deducted?
