Trying to renew my EAD/AP card but...

Hi, I'm filling out the form I-131. I'm hoping someone could help me. My card is going to expire in May 5th, 2015 so I need to renew it. I am still waiting to get my green card... So far I haven't had an interview the only thing that I got from USCIS is a letter from June 5th 2014 telling me that I am a Potential Interview Waiver Case but they also said that there is going to be a delay on my case due to workload factors not related to my case. BTW the letter said that in 6 months I should've heard from them... Well, 6 months passed and I filled for "Case out of processing time" and I got the same response "Your case is delay due to workload factors not relate to your case" REALLY??? I guess I didn't know that :ranting:

Ok, Now that I am filling out the form I-131 and question number 6. isasking me for Class Of Admission?? What is this?? I guess this is asking me for my current immigration status, right? I also had a similar question on the form I-765 asking me for my current immigration status? I wonder if I can type K-1? but my visa expire 90 days after I came to the US so the only option that I can think is Adjustment of Status?

Please let me know what should fill in those spaces?

Correct, your K1 visa is expired. Adjusting Status is the answer. You can include copy of your NOA you received after you applied for AOS, as well as copy of the Interview Waiver. Doesn't hurt to have an extra explanation

Just googled this a lot for you and I do not believe it means AOS.

Found this answer on a previous thread about this.

"'Admission' refers to crossing the border, so in this case, that's the last time you etered the US. 'Status' refers to staus while being in the US or the lack of thereof. You need to explain your grounds for eligibility correctly. Overall, the instructions are usually helpful."

So I would assume it's the last time you entered the states which would be a k1 if you've not left.

Hopefully someone else will reply soon with a legit answer.

"K-1", because the last time you were admitted to the US was in K-1 status.

Better answer? They received the correct one in this thread already. They were admitted into the US using a K-1 visa. That is their class of admission. If they have been out of the country and returned using AP, then they were paroled back in using their Advance Parole, not a new admission. Their current status is still K-1 visa holder, though they could also put, K-1 visa/adjustment applicant.

Guess all I can hope for is my green card arriving before late April... never thought itd take so long!!! I filed in January 2014 and had did everything correct

This is why it's recommended to file for a renewal 120 days before your existing documents will expire.

Unfortunately I only became aware this was an optionwhen USCIS responded 3 weeks ago to my information request suggesting I extend my EAD within 90 days of its expiration. If I dont have my green card by May then it'll be 16 months after filing! isnt that excessive!

After you get NOA1 for EAD/AP renewal, call for an expedite - Financial Hardship - Reason, employer stated will be terminated if new EAD/AP card not received by certain date. No Problems.

As I said above, you can (and should) file for renewals of your AP and EAD 120 days before their expiration date.

You can try for an expedite, which may or may not be successful.

As I said above, you can (and should) file for renewals of your AP and EAD 120 days before their expiration date.

You can try for an expedite, which may or may not be successful.

USCIS told me 90 days which was irresponsible of them. Well good news, I filed for expedite and before Id managed to fax in the proof of financial hardship for expedite and before they accepted expedite my card was magically put into production on tuesday, 30 days before current permit expires. I am currently 14 months post i-485 application and no news as of yet, last thing I heard was in january 2015 that they were still working on my case and should hear something within 3 months
