Question About Expedite For I-129F

Recently I filed the I-129F application with the Texas Lock Box. The file was sent to Texas for processing. Since Texas times are so long, we decided to request an expedite. We reviewed the criteria, and I inquired with USCIS about the request.

The day I filed the request on the phone, the agent confirmed a few of our personal details, then asked for a brief 1-2 sentence explanation. It was near impossible to explain the circumstances in 1-2 sentences, but that was it. I asked what the next step was, and she said "in 5-10 days someone from USCIS will contact you regarding documentation, etc". I was satisfied and began to prepare our case. I was excited for a chance to explain why we need this expedite. If they say no after reviewing everything, then the answer is no.

Anyways, the other day I received a "canned" generic email from USCIS saying they denied our request. I was so confused! I was never able to present our case to USCIS. They somehow made a decision based on 1-2 sentences taken by a less than helpful phone rep. I called USCIS and it did no good. I asked why I was told I would have a chance to present my case, yet no one has any answers.

What experience has anyone else had when applying for an expedite? I need to know what I can do to present my case, appeal, or re-file it

Requesting an expedite because of the service center your application was sent to is slow is no reason to be able to jump in front of everyone else waiting in the very long line. Is there a legitimate reason for the request?

What was your reasoning? I'm sending our app in an im going to include a letter for expedite and I have already gotten a letter from my job stating that I will incure extreme financial loss...including the amount I would lose. It's worth the try.

Yes, there is a legitimate reason. We meet two of the criteria on their website for an expedite.

I would try again with something to back it up!

Expedites are given under EXTREME circumstances with k1 petitions.

You may believe that you meet the criteria but you could be wrong.

I've only seen a couple of cases on vj where they have been approved that wasn't from the Philippines.

Those included medical issues mostly, one was on dialysis.

You do not have to disclose to us any information you don't want to, but knowing what you believe you can be expedited for would help people help you.

For anyone that applied, were you given a chance to present your case for expedite? I am just confused as to why I never had the chance.

Is the health situation on the petitioner or beneficiarys side.

If it is beneficiarys this could be seen as public charge.

The beneficiary is the one with the health issue we are addressing.

The financial loss covers both of us as well.

That could possibly be why.

Beneficiary can be seen as a public charge to healthcare.

America clearly defines why we have to have sponsors or that the petitioner makes enough money to cover us. But expediting due to medical reasons could put a hinge on the government spending money on non citizens.

Financial loss I believe in certain circumstances can be used but it is very hard to prove exactly how it effects both of you.

It's a tricky situation and I'd advise you to keep calling them to explain and enquire, try to speak to tier 2s, and supervisors, as high as you can get.

If you only get two sentences to explain, I wouldn't mention financial loss, that's way too hard to prove.

I'd try and explain in as little but graphic detail as possible the extent of the medical issue and exactly why the beneficiary needs to go to the states quicker.

It all depends on the needs of you both not the wants, and it has to be proven needs with facts.

Keep trying, don't give up. Besides it won't slow your petition down, so it's only a positive.

If there is an urgent medical need to travel to the US have you looked at a B2 for medical needs, would be much quicker.

Having said that the US is probably the last place some one would choose if they had financial issues.

Russia has excellent health care. What is the issue?

The financial loss covers both of us as well.
