Filing taxes jointly after marriage, but I need to get ITIN number- entered on K-1 visa

Hi,


I don't know if anyone on here can help, but I'm having trouble finding the correct info on the IRS website and would prefer advice from someone who's gone through this, or knows enough about this situation. =)


I entered the USA on a K-1 Visa and married within the 90 days and just sent off our AOS I-485.
My husband is the USC.

We want to file our taxes jointly but I didn't get a SSN (long story) so now I need to apply for the ITIN.

1. Does the name on the tax return have to match the name that I enter on the application for ITIN?
(might be a silly question, but since all of our I-485 applications had my married name, we put my married name on the tax return. But the ITIN form says that the name needs to match that of my passport as this is the document I'm providing.) So should I then change my name on our tax return?
The only proof of my married name is on our marriage certificate.
If only I'd gone to get the SSN when I could have!! (My I-94 expires in 3 days.)

2. What would be my 'type of US visa?"
I didn't know if I should put K-1 visa and details but that expires in 3 days.
Or if I should put in "pending I-485" or just leave it blank?

Sorry, I know this post sounds confusing!

Hope someone out there can help!!

(I also, don't know how to put the timeline on my posts.. I know that usually makes understanding the situation a bit easier.)

At tax time in 2007 we were waiting for AOS. What we did was file an extension (gives you until October 15th to file your taxes). Once Rin's EAD arrived, got her SSN and filed. The previous year had done the ITIN and it was more painful and took a lot longer (about 12 weeks) for the return/refund to be processed.

K-3

11/15/2006 - NOA1 Receipt for 129F

02/12/2007 - I-130 and I-129F approved!

04/17/2007 - Interview - visa approved!

04/18/2007 - POE LAX - Finally in the USA!!!

04/19/2007 - WE ARE FINALLY HOME!!!

09/20/2007 - Sent Packet 3 for K-4 Visas (follow to join for children)

10/02/2007 - K-4 Interviews - approved

10/12/2007 - Everyone back to USA!

AOS

06/20/2008 - Mailed I-485, I-765 (plus I-130 for children)

06/27/2008 - NOA1 for I-485, I-765, and I-130s

07/16/2008 - Biometrics appointment

08/28/2008 - EAD cards received

11/20/2008 - AOS Interviews - approved

Citizenship

08/22/2011 - Mailed N-400
