Hello,

I am a US citizen who married a Ukrainian citizen and my wife is in the middle of the I-130 process. Our baby was born last Nov., while I was there in all the excitement, I wasn't able to get to the US Consulate for CRBA for him. I'd like to start now, but I am having trouble getting vacation from work, so I'd like to know if there is a way to report my child and start a process of getting him the passport from US? Can I call the embassy or some service in US to do that? Anyone done it this way?

The US citizen have to be in person to request the service after securing an appointment date and time. The Non-US Citizen cannot make such a request.

"WHENEVER POSSIBLE, both parents should come to the Embassy together with the child and the above documents. IF ONLY ONE PARENT can come to the Embassy, please contact us for further instructions."

Okay, wasn't able to reach the embassy by phone, so I sent them an e-mail with the question about our options. Will see what the answer will be.

I was my understanding that me and my wife should come there, but if at very least, I should as US citizen.

Also, if we're not able to get the passport for the baby before my wife goes to US. Can the baby travel with her? She has a US tourist visa, so she can come visit me anytime. The baby just have to be old enough to travel.

The baby needs a passport to get on a plane.

1- As a US citizen, the baby should enter the US on a US passport.

2- Even if the baby could travel on a foreign passport (which is not allowed), the airline will want to see his/her visa before allowing the baby on a plane.

Got a reply from the US embassy. May be useful to others:

Please note that usually we need to see both parents and the child at the time of the application. If you are not planning to be at the Embassy at that time, your wife will need to present the following documents:

1. DS-2029 to be signed by your wife under oath in front of the Consular officer at the time of her interview;
2. DS-5507 (original) signed by you and notarized by a U.S. notary public;
3. DS-11 to be signed by your wife under oath in front of the Consular officer;
4. DS-3053 (original) signed by you and notarized by a U.S. notary public;
5. A copy of your U.S. passport or any other form of photo ID that you present at the time you notarize your DS-3053 in the U.S.;
6. If a copy of your U.S. passport is not available, some other proof of your U.S. citizenship;
7. Your wife's Ukrainian passport (preferably the one for international travel);
8. Your child's Ukrainian birth certificate with English translation;
9. Your marriage certificate with English translation;
10. One 5x5 cm passport photograph of your child;
11. Documentary proof of your physical presence in the U.S. for any 5 years (at least 2 of which after the age of 14) before your child’s birth. For examples of this proof, please see instructions for DS-2029.
12. The fee of $205.00 ($100.00 for CRBA and $105.00 for the minor's passport application) either in U.S. dollars or Ukrainian hryvnyas, or a credit card.

It is always better for both parents to be present (not a requirement) with the baby at the time of interview, but there is also a provision for the non US citizen parent to apply provided you submit all the required documentation. I would suggest that if you can make it, you should go for the interview.

Also be prepared for a DNA test, although not an absolute requirement in your case but it depends on the consular officer/not enough evidence to prove the relationship at the time of conception between parents and if there are fraud cases in that embassy/consulate.

Also the list is missing originals/copies of any previous marriage termination evidence of either of you.
