Jan 16 RFE status update online

Jan27 FIled RFE

Jan28 RFE update online

Waiting now....

my question: if I am applying for an AP now, will it slow down the whole process? or should I wait for the GC?

Bio Appointment : Jan 16

RFE Receipt: Jan 23

RFE USCIS Receipt: Jan 28

Your only applying for AP now? are you doing consular proessing or Adjustment of status

adjustment of status. I filed I-485, I-130 and I-765 already, wondering if I file I-131 AP now, will it reset the EAD processing time to the latest AP receipt time?

Im not sure if it will reset the time. sometimes they do combo cars which serve as one card which is both your EAD and AP card and seperate cards one for AP and one for EAD. I dont imagine they'd reset your EAD for processing a different form, but USCIS arent the most intelligent of people.

How long has your EAd been pending?

i filed on Dec 18 and just called USCIS, they said it will be one more month to go..even they are not sure what will happen..but my RFE was received on Jan 28, supposedly should hear something before March 29..

Well after you send your Respone to their RFE they reset the processing time. if it was a request for initial evidence pertaining to the I-485 or I-765 then they reset the 90 days to the time they recieved your response.

It sucks, but its true.

Theyve done it to me twice.

yes, it was RFE to I-485. Well they told me wont reset the time...dont think they are really competent then. So how long after RFE have you received interview? or where are you in the process now?

Yes they are idiots.

The USCIS people you ring and talk to dont know alot and give alot of the wrong information out, I've found that out the hard way.

I am waiting on everything. No EAD, No AP, 2 RFE's. it's been nearly 4 months since I filed.

I filed AOS in October 2014. Recieved RFE in November, they recieved my response in December and sent me a letter in January saying they reset the processing time for my EAD, from 31'st October (when I filed) to December 12th (when they recieved my response)

Then They also just recently-5th of february- sent me an RFE dated December 16th- asking for evidence. They forgot to send the 2nd RFE for 2 months, never told me my case was on hold since december 16th waiting for evidence they never asked for or told me about until Feb 5th. And I rang them up plenty during Dec and Jan and was told nothing.

Thats the kind of people your dealing with.

Yeah, hopefully. they have so many fruad's that they make it difficult for decent people doing things the right way, its not very fair.

Yes i got that notice too and it stayed like that for 2 months. I did my biometrics in November and still got no word after 2 months, only in February, asking for another RFE. I got my congressman involved to, no luck either.

Youll likely get your EAD and AP before the interview. Interview and GC is last.

Hopefully if all is correct it will go right for you, but from my own experience, I'd say be prepared to wait. USCIS havent been very efficient, quick or even fair with my case, hopefully you'll get better people looking at your papers!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
