@mbalih thanks so much but how do we withdraw the i-129F petition now because it has been process already and we can see how far it has gone on our case status on USCIS or should we just start all over again to file for another i-130 and pay the $420.00 fee again.

The problem is that the K3 visa won't even be issued without the I130 petition. As far as I have read here, it's back up if your I130 takes longer.

I'm not sure how you would withdraw it but it's the best option right now. Just go for the spousal visa! It's simpler.

Second to what mbalih said. How come they received and processed K3 visa without the I-130? I'm sorry that they have deducted the money for your K3 visa. From my understanding, you can withdraw the petition by calling or sending email to USCIS, but they would not return the money back. Correct me if I am wrong. After you're done with this, then you can resubmit your I-130. Just like mbalih said, it's simpler.

Ok I will inform my husband about this option but can we just get another money order of $420.00 and resubmit it with our i-130 form the USCIS returned or we need to fill out another i-130 again or just used the one the USCIS returned. Thanks @Mablih

@Maniput thanks so much for your advice and I guess the best option like Mablih said is to just resubmit the i-130 and pay the $420.00 again but I don't think there will be any need to withdraw the i-129F since the money will not be returned so let's just leave the USCIS to keep processing it and just resubmit the i-130 again with the correct fees of $420.00. Thanks ones again and may God bless you

@finben No problem. I pray you won't have any problem with the resubmitting and USCIS will accept all your documents! God bless you too.

Hi, does he have a birth certificate? I think that will suffice. The passport will be needed at NVC stage.

Hi there, if I'm not mistaken, you can elect anyone to be your agent. Amy fellow mates will comment as well.
