Well wifey says she called and spoke to a officer and she says there's a requirement in house prohibiting adjudicators from sending out RFE's for cases that are already approval, especially if those RFE's are of secondary importance such as a child's mispelt name where a birth certificate for that child is already provided

Timeline

A couple weeks ago I posted in this topic. I mentioned that I had filed for a fiance some time ago and it ended miserably. I have no hate for him and he and I do occasionally talk. I have a wonderful husband now and I am truly happy. But someone in this topic must know my ex and found the need to tell him what I had posted. He knows how the relationship ended and he knows why...Nothing has changed. I am happy to make this journey with someone who is travelling the same way that I am. So to whomever it is that found the need to go back and report to him...Thanks for clarifying things...lol. Now carry on.

Hello everyone.. Guys I just wanna ask.. My husband and I started preparing all the docs needed for me and my baby.. Is it affid of support need to pass along with the I-130? And do we need to attach the cover letter? Or only in the NVC?

cover letter with the i130, YES

affidavit of support and all that ####### is the NVC stage, you'll have plenty of time to work on that later.

Here's my cover letter, I make no claims its the "best" one, just what i sent.

Bear in mind that each case is different, your contents be need to be different than mine.

Also note that her birth certificate is not required. I sent it anyway because i had it.

Dear Sir/Madam:

My name is ____________, I am a citizen of the United States. I am filing the included petition I-130 for my wife, _________________. I am petitioning for her to obtain a spousal visa.

Please note carefully our address below, as I live together with my wife in Venezuela.

Please find enclosed the following required and supporting documents for this petition:

  1. Form G-1145, e-Notification of Application/Petition Acceptance.
  2. Check in the amount of $420 for filing fee.
  3. This Cover Letter
  4. Petition I-130 and 1 page continuation sheet.
  5. Copy of petitioner’s USA birth certificate
  6. Copy of beneficiary’s Venezuela birth certificate. Original in Spanish, followed by a certified English translation.
  7. Copy of our marriage certificate. Original in Spanish, followed by a certified English translation.
  8. Form G-325A for U.S. Citizen petitioner, and 1 page continuation.
  9. Two passport-style color photos of the petitioner
  10. Form G-325A for NON-U.S. Citizen spouse beneficiary, and 1 page continuation.

  12. Evidence of a bona fide relationship:

a. A short summary of our story.

b. Apartment rental contract in both our names. Original in Spanish, followed by a certified English translation.

c. Photo album from our wedding and the last 21 months together, labeled by date and occasion if relevant.

Copies of the documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an immigration or consular officer at a later date.

Hello everyone...Its been 41 days now since we got NOA1 and still waiting on NOA2. Some others gets their NOA2 quicker. It makes me wonder if we did something wrong, the anticipation is just killing me. Thinking of it, we did not include a cover letter as I didn't know it was part of it. in the USCIS website, I didn't remember seeing cover letter as part of the requirement but here in VJ, everyone is talking about it. As far as I'm concerned, all supporting docs and forms were complete and properly filled up except that, we did not include a cover letter. I have 3 questions in mind. 1) How important is the cover letter? 2) Has anyone submitted an I-130 before without a cover letter and yet had approval? 3) Can I still send a cover letter now? I would appreciate any thoughts and suggestions. Thanks!

I'm really confuse with the issue of this i-130 cover Letter that is coming up here now because when my husband filed form my i-130 petition there was no area in the uscis website that it was said that we should include a cover Letter along side with other documents or forms. Even when my husband was sent the i-797C of rejection of our form it wasn't indicated that he should include any Cover Letter the only reason why they said our form was rejected was because we filed for form i-129f along side with our i-130 and so they said we have incorrect fees and we should chose the form we want and take off the other and so my husband re-submit only the i-130 form and took off the i-129f and then wrote a little notice telling the uscis that the $420 fee is for the i-130 and he now re-submitted the forms back. So I'm trusting God to perfect and speed up all of our petitions.

I think cover letter is not mandatory. When I was doing Adjustment of Status, VJ suggested cover letter for the packet and lots of people used it. I did not and it wasnt a problem. I cant recall seeing any RFE ever on this site for cover letters on here either. Imsure its "nice" to have but not a "must" have.

Guys

There's no regulatory rule that demands that applicants and or petitioners use a cover letter. Some folks include it so the adjudicating officer can see easily what's in your file, without having to be combing through it looking for things. And besides, when they might send an rfe for something already included the cover sheet might help highlighting that you've already included it. Don't stress yourself. A cover sheet won't approve or deny you for sure. It only shows you did some good home work for your application

Thanks a lot for your reply. I thought so too that's why I subconsciously ignored it. I did made a separator sheet though for them to know where each set of file ends or begins. I put a long colored construction paper and labelled it on top to let them easily know what the documents behind it are. I just followed the way the requirements are suppose to be arranged as written in the USCIS website. I did the same thing when I applied for our sons Consular Report of Birth Abroad (CRBA) and I was praised by the consular officer for making their job easier as I arranged it properly, properly labelled, all copies were clear and pictures were properly mounted...With this I-130, I did the same...yet since this I-130 is different from the CRBA I was unsure for a moment.

But thanks a lot for your assurance that it's okay without. Now I can put my mind at ease. Please...any more thoughts are welcome. Thanks again!
