Hi,

I entered the USA on a K-1 Visa on Nov 17th 2014 which expires on Feb 14th 2015.
We married within the 90 days and got all of the necessary paperwork to put together the I-485 application (concurrently with EAD, AP applications.)

I posted the package a few days ago and UPS tracking showed that USCIS-Chicago received the package Feb 9th 2015.

Does anyone know how long it will take for it to be registered in the system that the I-485 application was received?
Should I be worried that the package was received only a few days of my K-1 visa expiring? (not sure how fast things are processed over there.)

If their documents show that they received the application into the system after Feb 14th does that mean that I'd be staying unlawfully even though I have proof that I posted the documents prior to the expiry of my K-1?

I know that I waited until the last minute, but this whole ordeal has been super stressful and we were waiting for a tax return.

It does not matter. There is no deadline to file for AOS as long as you married within 90 days of entry, which you did. You will be in a new period of authorized stay because you filed for AOS and your adjustment is pending. Any tiny amount of overstay you may have will never be an issue.

My wife entered the US in October 2013 and did almost the same as you.. Got married and sent in the AOS in February 2014. We received the Biometric and completed it in March and waited, waited and waited, too. Finally we received her green card just this January... so took about 11 months from initial filing. During this time her Passport was going to expire, then went to Washington DC and renewed it. Though you (and us) were with expired visa, the processing of the AOS will take care of that since this is the next step in getting a Green Card. Even in DC we had to show everything again, and they even kept her yet to be expired passport left us waiting for the new one which came just a couple of weeks ago. It was renewed in November. I kept teasing her she can not even wander around. No visa, no passport, no ID..hehe..

I had called in September wondering why it took so long and what was the status. I was told it was held up in Tampa, Fl where the Bio was done. In September they were still working on December's Bios, still needed to get to March.. sheesh... Waiting is such a unwanted necessity, but once filed, it is what must be done.

Your K1 visa expired with your entrance at POE. Your I-94 expiration is a non issue, you married within 90 days and filed for AOS ......relax !

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thanks for sharing your experience Barry! Definitely makes me feel better about my situation.. I didn't know it took so long to receive the green card! For some reason I was thinking 3 months for EAD & AP and 3-6 months to receive green card. At least I'll be able to work and visit home with the EAD & AP I guess.

You will be fine--my husband came to the US on Dec 4 2013 and we married on Dec 19th 2013--his I94 expired on March 3 2014 and we did not file for AOS until mid March which was after the expiry date--as the others have said you married your spouse within 90 days which is the condition of the VISA.

We just recently received our approval for AOS a couple of days a go--so relax and let everything fall into place--GOOD LUCK!
