Hello there.....I spoke to the consulate here in Auckland New Zealand and they told me that they will require an I-134 for my husbands K3 visa, which my mom and step dad will fill out as I live and work in NZ at present. If my mom and step dad are sponsoring him then why will another affadvit (I-864) be required once we're in the states? Once this is requested I will be his sponsor because at that time I'll be working in the US, does that then void the I-134 submitted for the K3?

the i134 is just to get your spouse to the US and is used for the i129f (k1/k3) interviews. the i864 is to keep them in the US and is for the i130 which comes after they arrive in the US if you file a K* petition, and at their interview if you ONLY file an i130.

that's how i know it, but don't hold me to it. :blink:

The I-134 is not contracturally binding, the I-864 is binding for 10 years or the beneficiary gaining citizenship. Some embassies actually state "do not submit the contractually binding I-864.

Patience is required for this process.
