I have a question about how to fill I-864. My wife is a U.S. citizen who is sponsoring my green card application, but her income level does not meet the minimum threshold because she has been a student. We are thinking of asking her dad (who does not reside with us) to become a sponsor.

In this case, should my wife fill in the I-864 at all, or is it only her father who needs to fill it in?

I have a piggy back question on i864- here is the scenario:

I may be leaving outside the US to tend to my dad as he is medically not feeling too well. I will be out for less than 6 months as I'm still an LPR. I will be either quitting my job or taking an extended Leave of Absence while I am away. While I am out, if my wife's application process progresses to the NVC stage and I need to submit the i864 then:

1. IF I am unemployment at the time of sending the i864, do I put down how much I have earned in the year so far? or will i need a sponsor to sign as well (I can cover the minimum earnings required before leaving and I have some savings as well)

2. I plan on getting a job fairly quickly as soon as I am back in the States as well as while I am out of the states but I wanted to know how this case is treated where I am temporarily out of the US

Appreciate your thoughts.

Hi,

1. Unemployment means your income is zero. Past income does not count. Only employment that will continue will count.

2. Case will continue until the I-864 is required. Without an adequate I-864, the case stop.
