I am under removal proceedings since February 2013. In April 2013 I got married to a US citizen but after a couple months the Milwaukee sub office denied my wife's petition for the I-130 and they canceled our marriage because my wife was divorced only 2 months before we were married. We did not know the law of not being able to marry for 6 months after she received her final divorce agreement. So that's why it was denied. Then we were married again in February 2014, we did procedure over again, however 4 months later we received a letter from immigration. My wife's petition was denied again. For same reason, they mentioned that, because it did not seem for them that 2nd time was much different than first time my wife applied. We were confused. So we decided to hire a new lawyer and apply again, 3rd time.We received receipt that our petition was received on 4th of August 2014, its more than 6 months now and we did not receive any letter/answer that my wife's petition was approved or denied again. My quastion is how long is it going to take max (I was told 5 months, but it is more than 6 now) and from your experiences, whats possibility for this petition I-130 to be approved, since I am out of status, still under removal proceedings and my wife applied 3 times for this petition. My lawyer told me we need to wait, I understand that, and we are waiting but we just want to be informed and see what to expect (whatever it is), and what our chances are to get it approved finally and then continue it step by step. Thank you very much for you time, any answer will be helpfull.

~8 - 10 months for a standalone I-130; that timeline may be elongated in light of your prior denials.

Thank you for answer.Really, that long?I though they will make decision earlier, especially cuz they are going to be so busy after Feb. 18.We will see, its almost 6 months and half, and im still waiting. So,does anybody know if my petition will be approved or denied, I know its hard to say, but im just wondering, and this is so stressful. How will this Obama's immigration program effect my case?Since he said they are not going to destroy the families?I was in USA 4 times, legally, and every time i went back to Europe before my visa expired.Last time (3 years ago), i was working as a truck driver, and i met my wife, she was divorced and she lived by herself, so we started to living together, but the thing is she didnt get the final dovorce agreement from court, so we were not married at that moment.Accidentally, one night i passed Canadian border by my truck, and my visa was expired, so i got arrested and put in a jail for 7 days, and then i was released after my wife paid bond.So thats why they put me under removal proceedings. Then we got married and started all of that but its taking forever, especially cuz my wife's petition was denied twice.Im just wondering, does it mean anything to them if they see i came in legally, i was here many times and went home on time, i got under removal proceeding by accident I didnt do anything on purpose (Im not sure how they count every single case, every deportation conditions) I have a high income and I paid the taxes with my wife last 3 years, we have a million evidences to prove that our marriage is real. So, since i dont have to much experience with this please give me any answer, any advise, assessment, your opinion.Thank you so much, and I really appreciate your help.
