hi everyone,

Just want to help a friend. she is asking me what are the good reasons for granting visa extension?

she is now on a tourist visa and would like to extend for additional 6months because she want to celebrate her bday here on October. And wants to see other places as well. Are those reasons valid for grating visa extension. ?

What if, her stays expires and still she is waiting for the result. Does she has allowable stay upon the expiration of her stay when the application for extension submitted already?

What if, her application to extend denied. How many days are her allowable days to leave the US?

Provided that her reason for asking for an extension isn't deemed as frivolous by USCIS then she can remain past her authorised stay if she has already filed an I-539 to extend her nonimmigrant status. This is called "tolling".

It doesn't take six months to celebrate her birthday, so it's unlikely her request would be approved for that. It will probably take about three months or so to receive the denial notice.

I believe that after a denial you are given 30 days to leave the US.

is it a 1 entry visa? what's the duration on the visa?

if multiple entry across 2 or more years, suggest she go home, then return in october.

If the extension is deemed frivolous, then the extension will be denied and the visa will be canceled.

Your choice to file or not.

Mother-in-law wanted to stay longer to visit her daughter and granddaughter, what the heck form did we fill out, recall it was 300 bucks to extend her visa, actually the I-94. Just wanted to spend more time with her family.

See its 375 bucks now.

Also the price to have your return airline ticket changed, that was an extra several hundred bucks.

There is no nee for her to stay from mid March to mid October for her birthday, and USCIS will wonder how she can stay so long and support herself without working illegally; it also brings into question if she will return home at all, if she has more people in the USA to celebrate her birthday with than at home.

Better option is to return home now, then come back for a month or whatever in October to celebrate the birthday.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
