CR1 ISSUED FOR HOW LONG?

Helloooo!! I am posting on behalf of my friend. She is from Peru too. She got her visa CR1 in january, but it is going to expire in July , she can't travel to USA yet because of her son's issues...is this normal? why do they issue the visa for 6 months?

6 months is the maximum validity for all immigrant visas. This is set in law.

However, your friend can ask the embassy or consulate to extend the validity of the visa. They might do it if she can show some extraordinary circumstances., ie. if her son is very sick and can't leave the country.

Thanks SCY!! It seems as it was a nightmare for her really. She got married to guy in November 2004, he is a military and had to travel to West Meddle so when he was there sent the application it took about 1 year to get her visa , but she can travel, but she doesn't want to do without her son, her son's dad doesn't want to let him travel abroad , he is being very selfish. She is applying to get a special permision in the Court, but she is not sure how long it is going to take . On the other hand, she has to travel before her visa expires.....Do you think that She can extend it in the Embassy?

How was her son able to obtain a visa when he wasn't given permission to immigrate abroad by his biological father? I think that if she was to tell the embassy now that she wants an extension because her son doesn't have permission to travel, the embassy will question whether or not a visa should have been granted at all.

In my opinion, not having permission to travel is not a valid reason for extending the validity of the visa. That issue should have been sorted out prior to her making an application for the visa.

I don't know anything about Peruvian family law. I doubt the Lima embassy will extend your friend's visa validity due to her neglecting to obtain permission to travel for her son. Your friend should ask anyways, the worst they will do is say no.

If the visa is not extended, your friend should travel to the US, obtain an I-551 stamp in her passport to show that she is a LPR, then turn around and return to Peru to do what she needs to do. It's costly but I think that is the best solution.
