K-1 was revoked. Please what the next step

Goodday, please I need advice on the next step to take.
My fiancee (USC) file for me for a k-1 visa on July 2014. On waiting for the visa process, October when she and her family visit Nigeria, we decided to do our traditional marriage ceremony. On 5 February 2015 I went for my interview but unfortunately I was denied on the basis that we are married.
The below statement paper was giving to me.
Dear visa applicant,
This office will be returning your petition to the United State with a recommendation that it is revoked. The preponderance of the evidence presented indicates a marriage to the petitioner (name) exists. A fiance visa cannot be issued to a married person. Therefore this petition is invalid. Your case will remain pending under section 221(g) of the immigration and nationality act while it is returned to the national visa center for their review. When their review is complete, they will contact the petitioner, who will then have the opportunity to respond. If the case is reaffirmed, we will contact you to set up a new appointment date. If the case is not reaffirmed, the petitioner will be notified and the NVC will close the case.

- questions?
- please what do we do now.
- how long will it take for NVC to respond to the petitioner.
- please I really need an advice.

You need to file for a IR-1, CR-1 marriage visa. It was a terrible idea to have the ceremony and I am sure everyone here told you so.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That was a bad Ideal to do a wedding ceremony A k-1 visa is for fiancée ( notice the word fiancée). If you actually did get married the k-1 visa will be revoked and you will have to file for the CR-1/IR-1 visa. That will take longer and there is no refunds for the K-1 processing fees

If you just had a ceremony but did not actually get married, then you will have to prove that you are not married, that might be hard to do, seeing that you are filing for Nigeria. So you might have to get married and file the IR-1/CR-1 visa

In some cultures / countries, a ceremony can be made where the marriage is not official. The Embassies of these countries understand the cultures where they are located and do make consideration for those.

On 5 February 2015 I went for my interview but unfortunately I was denied on the basis that we are married.

Obviously the ceremony you undertook was regarded by the Nigerian US Embassy as a true marriage, not just a ceremony. Maybe you had the wrong ceremony, but that is in the past. You are now married and can't change that.

Have the petitioner send a notarized letter officially withdrawing the K-1. Wait a few weeks and file for a CR-1 Spousal Visa.

- how long will it take for NVC to respond to the petitioner.

Weeks to Months....not worth waiting.

- please I really need an advice.

You got married. So file for a CR-1.

Unfortunately there is nothing you can do but start all over and file a I-130. Be sure to file a marriage certificate with the registry you will need that to file.

Although you did a traditional you know for Nigerian thats as good as married and to immigration that is married. Sorry. You must have showed traditional wedding pictures and all that. Sorry you didn't know better.

It will take from filing to Visa in hand about 1 year. Get your evidence together and file.

Read the guides and come back and ask questions when you need help. Sorry for your delay. Be sure when you are ready to start that you write a letter to withdraw the I-129F/K1 petition. There is nothing that can be come of that.

When you file your I-130 petition with USCIS you will have your withdrawal letter attached to your package all the same place.

But this time you will send to Chicago Lockbox since it shows you live in Georgia according to your profile.
