FBI name check

I've recently obtained a K-3 visa and filed for AOS. We have our appointment scheduled for 2/20/07.

My question is, does the K-3 visa also require an FBI name check for applicant/petitioner? If so, can this name check be used as well by the USCIS when working on the AOS case?

We have just read a few posts where people get stuck waiting for this name check. It would just suck having to wait longer b/c of this reason.

Once you file for AOS it appears like the slate is cleaned as regards to name check, i.e. even if they did a check for your K-3 visa, they do it again (and I think differently) for your Green Card. So the answer to your question is that you have the same chance of getting stuck in name check hell as anyone else I believe.

My advise is to not stress name check until you know for certain it applies to you however.

Any checks done on you while your visa was being processed were run by the State Department (DOS).

Your AOS is processed by USCIS.

USCIS and DOS don't use each others data.
