I-864 most confusing form on the Planet!!! Solutions to confusions...

Hello Everyone,

I am at NVC stage and about to fill I-864. My dad will be supporting me and my husband so I am guessing that this is what joint sponsor is.

I am the petitioner, as I-864 needs to be filled by my dad and me both.

Part 1. on the form says 1.d. I am the only joint sponsor. (Which option should i choose here and which one should my dad choose ?)

Part 3. Which option to choose (I am sponsoring the principal immigrant ) My dad will be the sponsor for the principal immigrant or me ?

I am just confused who is the main sponsor... does my dad mention my details on his for as well or on his I-864 he is the sponsor ?... :help:

The above may sound stupid and for some it may seem very easy. Is there any form sample which I can follow ?

Hope someone can help me in this regard.

As I will be using my dad's income to represent us, Can I write N/A where it asks me about my income ?

In the Family member section does my dad list the details of household members or do we just mention my husband as he is the only immigrant ?

If you are using your dad as a joint sponsor...income will be used from his tax returns. you can't put n/a...put his income. in the family section put one for the intending immigrant and dependents if applies and put one for spouse also...

your household is you and your husband if you don't have any children

on your dad's i864 it depends on how many is his household size

No I left my job. I do pay taxes and file my taxes every year as I have student loan and a few bills.

My dad as 1 household member dependent on him which is my mom.

In total my dad will mention 4 household members right ? (DAD,MOM,ME and My Husband ) ?

In the part where it ask you for Sponsors household size it would look similar to this.

Part five Num 1. 01 as it is in of Part 3.

this applies to your Dad. Num 2. Yourself. 1

Num 3. Married: 1

Num 4:Dependent child 1 as you are only dependent child.

Num 5.Any other dependents 0 if none

Num 8. 4

Also i think you also need to file I-864 from your self.

send copies of IRS Transcript or W'2 for income proof.

here is how it was for my cousin when he filed his I-864 for Spouse in India.

BTW his case just completed 4-5 days ago. Interview is scheduled at New Delhi.

that's in case you are filing for someone other than your spouse

are you your dad's dependent? are you on his taxes?

if not, then he doesn't include you

you file the i864 total 2, if you aren't a dependent then you're not included and household size is 3 for your dad

Hi,

I file my own taxes and I am not listed as a dependent on my dad's household.

Does my dad still mention PART 5 (if you have dependent children,enter the number here) as 1 ??

Your dad isn't supporting you, he is supporting the intending immigrant. You are a USC so unless your father claims you on his taxes, which he doesn't, you are not mentioned on his i-864 at all. He does need to count his spouse and any children he has that are under the age of majority (18) no matter where they live.

You are the main sponsor. He is your joint sponsor. I'm headed to work but i can help you with the rest of the form when I get home if you wish. It'll be much later today however.
