Just joined VJ but I have been reading the information provided for some time. I wanted to get your guys input on a dilemma that I am having. My fiancee and I are set to get married overseas in October 2015 and we will be moving to the US to live. I understand the differences between the K1 and K3 visa but we don't want to wait until the K3 gets approved to start our lives together. I am considering applying for the K1 before we get married and having her enter the US under the K1 visa, so we do not need to wait at least six months for her to live in the states. The catch is that we will be married officially overseas before she enters the US on the K1.

Any suggestions on what I should or which is the best route?

If you are married then you do not have the option of a K1, you will be going for a CR1, takes about a year.

K-1 visa

A K-1 visa is a visa issued to the fiancé or fiancée of a United States citizen to enter the United States. A K-1 visa requires a foreigner to marry his or her U.S. citizen petitioner within 90 days of entry. Once the couple marries, the foreign citizen can adjust status to become a lawful permanent resident of the United States (Green Card holder).

K1 is for unmarried folk. K-3 chasing is a waste of time. CR-1 may be best for the married folk.

Maybe rethink yer plan a bit ?

what country does the foreigner hold a passport from, and what country is the foreigner IN?

I will suggest researching on this site a little. look at the pros and cons of the k-1 FIANCEE visa and the IR-1/CR-1 MARRIAGE visa.Forget about the k-3 visa it is hardly given out and is not worth going after.Read the guides on both especially the one you decide on. Read some of the posts in the region forum of the country you are applying from. This a good information site,and people are willing to answer any question, but you need to take time and look at the guides and the forums and anything on here that will be useful to you.

if you are set on getting married over there you can not do the K-1 fiancee visa. It one or the other you can not do a combination of both.

ok - is 'meeting in person' a problem for her? or for you ?

reminder - Taiwan has a VWP program now, but must apply for it, some version of ESTA,

then she could easily get on a plane and come to you.

You don't have a choice when you get to start living your lives together unless you plan on moving abroad. You either must wait for the K1, in which you get married in the USA. OR you get married abroad and must wait for the CR1. Sorry, those are the choices.
