I've never heard of it, but I think it's worth mentioning that I file single on my taxes, as my husband is not here yet. I had to research the information on Turbotax and verify with my lawyer that filing as a single person was correct, as my spouse resides in another country until his Visa is approved. *fingers crossed*

I'm crossing my fingers with you! :) others have filed single as well that's why I created this topic to figure out weather it really was a issue or not! But from what im gathering of course you should file as married because that's what you are but seems not to be a biggie . But of course if someone has had an issue with it then yes it's a biggie . But don't know! I'm search more see what I can find out to give real facts :)

I haven't done my taxes yet so for all that's reading I did not file single lol .

I-130 Approved: November 14, 2014 
after two service request

NVC6 months
Received : December 1, 2014
Received DS-261 / AOS Bill : January 1, 2015
Pay AOS Bill : January 9, 2015
Submit DS-261 : January 7, 2015
Receive IV Bill : January 15, 2015 
called after AOS showed paid, they released it overnight)
Pay IV Bill : January 23, 2015
Send IV and AOS: January 29, 2015
Scan date: February 3, 2015
Checklist: March 19, 2015
 (only need to send south Africa police report)
Case Complete: June 3, 2015 

EMBASSY: 10 months
Interview appointment letter : December 4, 2015
Interview Date : January 21, 2016 
medical wasn't complete
Second interview date: April 4th 2016
Interview Result :APPROVED!!!

Visa Received : 4/13/2016 ( they sent us a email stating our visa was ready for pick up)

USA LIFE
US Entry :4/29/2016 
Social Security : 5/10/2016 (filed from the actual office)
State ID: 5/14/2016
Started working!!: 5/25/2016
Finally paid green card fee: 6/24/2016 ( note said we will receive it within 60 days)
Green card in hand: 7/5/2016 10 year green card we done!! 

1st king born: 6/30/2016

April 2017 update: Marriage still going strong, baby boy getting bigger. Life is good

Your lawyer has no clue what he's talking about. Filing single isn't correct when you're married, regardless where your spouse is.

OP - filing single could cause issues during interview but it depends on overall case and amount of other evidence. It certainly does not equal to denial.

IRS is the one that may have problem with it so question is - why would you do it ?

Thanks! that's what Darnell said and abother person so pretty much confirmation :) it's a mute point at the interview if your evidence is solid

By no means should anyone file single but this was for the ones that have already filed single . As a extra comfort I wouldn't file single and of course who wants to deal with irs ! Lol

I have heard a number of couples that got an RFE at the NVC stage to re-file their taxes correctly before they could receive their case complete. So no, they didn't get a denial at the interview because they had to correct it before it could even move to the embassy stage. I suppose if one didn't comply with the law and didn't do what the NVC RFE requested a couple could be denied at that point. There wouldn't be a denial from USCIS because tax returns aren't part of that petition.

Like a previous poster said: married is married and the taxes must be filed that way. When I filed our 2013 taxes I had planned ahead, got a certified copy of my husbands passport and applied for an ITIN number so we could file MFJ. Where did I learn that? VJ and IRS.gov.

Yes toyr corrext if you are given a checklist for it at NVC but as most have already sent their AOS for NVC without 2014 so there will be no rfe given and with that said most will get cc at NVC . And yes married is married :)
