Your situation is very similar to my current situation as far as cohabitation is concerned and that worries me.

We are currently in divorce proceedings and should file 751 mind 2015. we were married for almost 3 years but i worked in a different city 2 hours away and was home weekends.Mine though was a problem of abusive wife and i am the one who ended the marriage.

my fear is that they will find it hard to believe that i couldnt find a job in my home city. i did a few interviews. my field is rather specialized.

We had a daughter together just before we married and i am hoping that will help.

pls keep me updated of new developments on your side.i will too.

I could really use some advice right now. My wife and I met in college and started dating. I graduated and started working on OPT. She was still in college. Then I found a job in a difference city that was willing to sponsor my H1B. So I had to relocate. After relocating, I married my wife even though we were living apart because of her college. My company asked me if I want employment based greencard but I turned it down because my wife is a US citizen and I thought I will get it through marriage.................

I think you having a daughter with your ex-wife is a very strong evidence. Also, I think they will understand that it's not that easy to find a good job in other cities. All these things make sense. I personally think that you will be fine. I will keep you posted with my developments. I believe USCIS will eventually see that our marriages were genuine. It may take a while but eventually decision will be in our favor.

Sadly, a child is not a commingling evidence for bonafide marriage, in USCIS perspective of course. Good luck.

Sadly, a child is not a commingling evidence for bonafide marriage, in USCIS perspective of course. Good luck.

I have read it several times that having a child is a very strong evidence if his/her birth certificate has both parents name on it.

Nancy was right. This sounds stupid but a child is not a first evidence for genuine marriage according to USCIS.

Please read this article. It says at one place, "The birth certificate of children born into the marriage will also be strong evidence of a bona fide relationship." I have read the same thing at several other places.

having a child/children together is a very strong evidence of genuine marriage especially when the couple have been legally married. this do not happen in just one stand. showing the couple involvement in the child/children's life will validate this as the best evidence ever.

there is no cut and try in this my friend. every case is unique and trust me uscis uses its discretions better than perceived out there.

A child birth certificate is not considered primary evidence for bona-fide marriage, it has been talked many times here.
