Hi!

I am a Permanent Resident in NY. My fiancé lives back in Serbia. What is the best way to bring him to The States and what are the waiting times? We were thinking if he can come here on a tourist visa first, and then we take it from there. He is currently unemployed there, but he can show other ties to our country, e.g. he has property in his name, his family is there, bank account, he has no criminal record. Please help!!!! We really need to find a solution!!! I We have been together for so long, and we just want to start our life together!!

Any ideas, suggestions, anything?!?!?!?

go to Serbia, marry him, return and petition him, it can take around 2 years

you being only a LPR, you cannot file a K1 fiancé visa, only USC

and if he got a tourist visa he can visit but never overstay since he doesn't qualify to adjust status in the US, since he has to wait 2 years, overstay isn't forgiven

No, obviously he is not going to overstay if he comes! That would be like digging our own grave

No, I have 2 more yrs before I can apply for citizenship. And as for tourist visa goes, is he supposed to say he is coming to visit ME, or just visit? We are worried because he is currently unemployed over there, and that should be one of the most important "ties" to the home country

He is supposed to be honest. Misrepresentation can result in a lifetime ban.

It sucks that other people abuse tourist visas and make it harder for legitimate users of them. :(

No, you don't understand. He IS going to go back if we decide to go that route and he gets a visitor visa, because we don't want to risk applying for immigrant visa for him. And we will do that as soon as we are able to. We don't want to break any laws and risk his life ban from the US. Absolutely not! And for being honest, of course! That goes without saying... Because we can only screw things up for the future visas or AOS.

I didn't misunderstand at all. I was being sympathetic.
