Hello,

I am getting ready to file and I noticed my fiance's passport expires in May of this year.

Can I still file even though her passport will expire during the process or do I need her to get her new passport before I file?

Thank You.

.

You can file but before the interview you need a new passport, otherwise they can't give you the visa.

The passport should have been valid at least 6 months prior K-1 visa application is started to process. It means, you have to ask her to renew it since you just getting ready to file I-129F assuming the I-129F will take up to 6 months to get approval.

Yes, you can file. Your fiance's passport will not be needed until after the petition is approved and your fiance is getting ready for the interview, the passport will need to have to be good for at least 6 months or visa will not be issued.
