CR-1 OR K-3?

Timeline

Hello I'd like to know which should I file for my case. What is the difference?

I am a US citizen. And my husband is Mexican. He and we got married Sept. 12 2014 (so less than 2 yrs). Our marriage is legally by the US. We got married by Texas at the US/Mexican border. Now I would like to petition for him to live as a resident here in the U.S. How would I go about doing that? He has never had any type of visa. He has never been to the US. Thank you.

File I 130 with a copy of both of you birth-certs, marriage cert

MO $420 and follow all instructions to fill out form, be sure to

re-check your answers, sign form and send to correct address

It seem a str8 forward case so any questions you have you can

ask here, you can apply today. If he has an arrest or record in his

country it must be revealed, and its a good idea that he not get

tattoos while waiting on his papers sometimes they question tats.

if he smokes weed he should now quit

You should file for the IR-1/Cr-1 spousal visa. The K-3 visa is hardly giving out. The K-3 visa used to be a faster way for a spouse to get to USA while waiting on the IR-1/CR-1 visa. That advantage is long gone, as it not taking as long for spousal visa to be process.

Other disadvantage of the K-3 visa is you will have to fill out two petitions the I-130 and The I-129f for the USCIS. you will also have to file adjustment of status later in the USA

With filing the IR-1/CR-1 visa ,you will only send in the I-130 petition package. the adjustment of status will be done before visa is issue

First step for the IR-1/CR-1 visa is to go to USCIS website and follow instructions for The I-130 petition .
