screwed over by social office? anything I can do?

So, I applied for my SS card during December but still hadn't received my card even though the officer at the social office said I had provided all necessary paperwork.

So I called today and the person on the phone said I had applied too late as my i94 expires on 16th Feb and I was supposed to apply more than 2 weeks before it expires. Obviously I did but the SS office didn't process my application on time! So they are now saying that there is nothing I can do. I'm thinking of writing to the local governor to see if they can help but I'm really not holding out much hope.

We got married on the 31st Jan and are now preparing to send off the paperwork for adjustment of status...

Help anyone?

You need to contact Federal people--your Governor can do nothing to help you. You might start with the SSA themselves. You might want to politely inform them that as an non-immigrant allowed to work per the K-1 visa you are allowed to apply for a SSC with the following documents as a non-citizen:

To prove your U.S. immigration status, you must show us your current U.S. immigration document, such as Form I-551 (Lawful Permanent Resident Card, Machine Readable Immigrant Visa) with your unexpired foreign passport, I-766 (Employment Authorization Document, EAD, work permit) or I-94 (Arrival/Departure Record) or admission stamp in the unexpired foreign passport. If you are an F-1 or M-1 student, you also must show us your I-20 (Certificate of Eligibility for Nonimmigrant Student Status). If you are a J-1 or J-2 exchange visitor, you must show us your DS-2019 (Certificate of Eligibility for Exchange Visitor Status).

I would state to them that it does not say the I-94 must be unexpired, but it is the passport that is unexpired. I would also point out that you did apply before the I-94 expired and it was their mishandling of the application that has allowed the I-94 to be close to expiring, but I would strongly point out that the I-94 is not expired and you are still a K-1 visa holder--I would hold off stating you are married as long as possible, but you are still a K-1 visa holder even after marriage.

If that does not work then you can go to the POTUS as he is over the SSA as the SSA is their own federal agency. Congress critters will not help either as this is an executive brank agency with no Congressional oversite.

If this does not work, file the AOS and when the EAD card arrives go into the SSA office and get your SSC.

did you fill out the SS-5 in visa name or married name?

if married name, sorry, DHS verification kicked in.

i've a howto in the SSN section, have a read when yer able.

also, you should have been issued a receipt of some sort.

I say go back in person, get a supervisor, and don't leave till it's all sorted.
