Lawyers don't necessarily make things faster, in some cases they create errors which slows the process.

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

No bars, no waivers required, never out of status, no overstay, no violation of anything ever. She simply had an asylum case (which was handled by an attorney) with appeals that was finally denied and so we felt she should stay legal and take Voluntary Departure. I am doing the K1 filing without an attorney (I am not an attorney but I deal with legal matters quite a lot and am good with details.) Based on my observation of her Voluntary Departure process, I have a vague (and probably baseless) suspicion that it might have been mishandled, and so I am sensitive to any early indication that my K1 application might have been put in the "hold" category.

You're giving USCIS too much credit. They're not that pro-active or competent. Whoever processes your file will basically just run down the checklist to make sure your application has everything. If it doesn't, they'll send you a RFE. If it does, you're approved. If they're puzzled by anything, they'll send you a RFE. They just won't put it in some hold file. There really isn't any grey area when it comes to USCIS doing this stuff. At least not at this stage.

And your NOA1 is one month old as of today? Check the case numbers before and after yours on the USCIS website and see if they've been approved. If not, then you definitely don't have any reason to worry. If they have, then there is a good chance you'll be soon.

Unfortunately you have no recourse to do a single thing for 4 more months unfortunately. You just have to wait. Out of ____ cases I've read about from CSC in the past few months on this board, only one person (sco/wen I think is his user name) has had an extended wait (5+ months) from CSC. There really is no reason to worry yet.

No. We did consult with a lawyer, however, after leaving our 30 minute interview, I wasn't too impressed with her (nor her price tag), and I left with a sense that we could do this on our own. Lawyers won't help you with anything time wise, they just make sure things are organized and sorted-so, if you're disorganized, hire one, but if you can follow the K-1 guide that's available on this website, you'll be fine. They'll need you throughout the whole process anyway, as they need your information for the forms, etc. Waste of money in a process that already costs quite a bit.

Thanks very much for your comments - I see that one of you is from Indonesia as well. I thought I would post a quick update and see if anyone has any other ideas.

I did as you suggested and looked up the five K1's immediately before and immediately after our receipt number. All (except ours) have been issued NOA2s, some as much as 3 weeks ago. In looking at the VJ data, I notice that there have even been some applications submitted around the same time as ours which have received RFEs, responded, and received NOA2s already. It looks like the CSC is cranking these days, with some NOA2s back in as little as 10 days from the NOA1 date and 60% of the VJ K1's filed throughout the month of January having received NOA2s.

My point is it appears that something strange is going on with our application. I have not received an RFE, a rejection, or any notice of any kind. I don't want to wait for six months only to find out that there was some sort of administrative goof up and have to start again from scratch.

I had one idea - I was thinking of making an Infopass appointment to physically go in and ask about this. Does anyone have an opinion as to whether 1) I am likely to get any useful information, and 2) whether this could have negative ramifications on the process?

Hi all,

My I129F for K1 was received by CSC and I have received an NOA1 dated 1/5/15. When I look at the data here on VJ for other K1 filers at the CSC it seems that many with NOA1 dates as late as 1/22 have received NOA2 already. Elsewhere on VJ I read an interview with a former USCIS examiner and he said they review applications strictly in order of receipt date; upon review, they either approve and send NOA2 or "hold" for further review or evaluation. Given this, it is clear that either 1) they do not review in order of receipt date, or 2) we ended up in the "hold" pile.

I set up a MyUSCIS account and have added my receipt number. It shows "last updated" date of 1/7 with no further information. I read somewhere that every time they handle the application, they will add a record to the case in MyUSCIS.

Does anyone have experience with this - should I be worried? Can anyone help me understand what might be going on? I called the USCIS customer service number but they were clueless...

1/13/15- Received by USCIS

1/15/15- Notice date

1/24/15- Received hard copy NOA1 in mail

2/18/15- APPROVED - text message 9:30pm

Unfortunately I don't think you'll be able to find anyone that will be helfpul at this point. The infopass person in my experience was just like a Tier 2 person on the phone. It won't have any negative ramifications though.

You can only try phoning NVC or emailing CSC directly. I know this doesn't help but you are within the 5 month benchmark, nothing else you can do until you get to 5 months. I'm in the TSC line and it's miserable so be glad you are not there!! All you can do is keep calling them.

Same here

All cases around us are either approved or had RFE. Ours wasn't touched since feb 4, nothing.

People from TSC- as much as I feel sorry for your unfortunate situation of months and months if waiting, your remarks and comparison is not helping us. We have cases approved in 9-15 days and when ours are not, we do start worrying, and the sad situation in TSC has no application here

Thanks. i don't suppose there is any benefit to going to the consulate in person at this stage (before even NOA2)? I was thinking of going to Surabaya in a week or two so I would be there anyway. It is unlikely I will go there for the interview (if we ever get that far.)

Yeah, all K-1 interviews for Indonesia are in Jakarta, not in Surabaya unfortunately. The medical exam has to be done at a specific clinic in Jakarta too. A pain in the ####### for those who don't live in Jakarta or near it.

Anyway, the state department will have no record of your petition until USCIS sends it to them.

I doubt it. I did the same thing, I think you should be fine.
