I129F/K1 NOA2 not yet received - should I be nervous?

Hi all,

My I129F for K1 was received by CSC and I have received an NOA1 dated 1/5/15. When I look at the data here on VJ for other K1 filers at the CSC it seems that many with NOA1 dates as late as 1/22 have received NOA2 already. Elsewhere on VJ I read an interview with a former USCIS examiner and he said they review applications strictly in order of receipt date; upon review, they either approve and send NOA2 or "hold" for further review or evaluation. Given this, it is clear that either 1) they do not review in order of receipt date, or 2) we ended up in the "hold" pile.

I set up a MyUSCIS account and have added my receipt number. It shows "last updated" date of 1/7 with no further information. I read somewhere that every time they handle the application, they will add a record to the case in MyUSCIS.

Does anyone have experience with this - should I be worried? Can anyone help me understand what might be going on? I called the USCIS customer service number but they were clueless...

I am guessing- they did handle your petition on 1/7, and put it aside to the 'send RFE' pile.

If you look at the stats of when RFE was sent, it varies greatly, and some are sent weeks after NOA1 date.

It's been one month since you received your NOA1. It is perfectly normal for you to not have heard anything yet, even at CSC.

If you had gotten an RFE, you would have heard about it via text/e-mail (if you have that enabled) or seen it on the MyUSCIS site.

Finally, you will not see a record of every time someone has "touched" your case. Sometimes you can get this information by calling the National Customer Service Center, but since you have been waiting for such a short time, I would continue to wait patiently.

10 months for an NOA2 from CSC? That is not consistent with the data aggregated by VJ.

The reason I may seem overly focused on this milestone is she left the US on Voluntary Departure around Christmas. (She has been living in the US for 15 years and we have been together for 5.) I have reasons to believe her Voluntary Departure case may not have been closed out properly due to mishandling by the USG and this could be the cause of a delay. If so, I want to find out asap and fix it.

I am aware the entire process will take some time.

No bars, no waivers required, never out of status, no overstay, no violation of anything ever. She simply had an asylum case (which was handled by an attorney) with appeals that was finally denied and so we felt she should stay legal and take Voluntary Departure. I am doing the K1 filing without an attorney (I am not an attorney but I deal with legal matters quite a lot and am good with details.) Based on my observation of her Voluntary Departure process, I have a vague (and probably baseless) suspicion that it might have been mishandled, and so I am sensitive to any early indication that my K1 application might have been put in the "hold" category.

Yes, the data shows CSC is not expecting to take as long as 10 months like those who are filed at TSC... However - USCIS states their processing time is 5 months. I don't care what amount of data you throw at it, you shouldn't be planning anything less than 5 months.

Right now TSC is at a snail's pace. Who knows what may happen in a month, two months? CSC may start to crawl, etc. You never know what will happen. You are not even at one month of filing yet, you won't even be able to inquire about your petition at CSC until 5 months. I would just be patient. Don't forget too - the NOA2 is not the last step. Just getting the medical, paperwork, interview can easily tack on an extra 2-3 months or more. Worst case you end up in AP. Also, VJ data is only a tiny portion of the amount of cases that are received by USCIS for K-1's each year.

Sorry, I know it's exciting to look and see how quick CSC is, but don't get your hopes up - anything can happen.

Not sure really. I called USCIS the day I received the NOA2 and she said we'll have to get it corrected for you. I've read here and elsewhere it isn't a problem. It's up to you, I doubt it will change anything to be honest. I was going to call and cancel my inquiry but apparently it's not worth it. I can always let you know once they assign it for processing and I receive a response.

Well, on that front, when I opened the inquiry I confirmed with the agent that it was indeed shipped off to the NVC, she said yes. To confirm it I just got off the phone with them and a case number was assigned after it was received today! I would say it probably won't affect it either way, I will message you when I hear about the inquiry though.

If I read correctly, there has been some issue with a past visa, or some kind of dealings with USCIS, if so, even if all turned out fine, it is a red flag to me. They look at this stuff very close.

I could be wrong, but is just my opinion. Past issues with the govt., is always a problem more than likely.
