Hello all together,

I have a question, is there any recommendation on how long someone should wait before marrying after entering by a K1 Visa?

My idea is, to marry in court one day after entering the U.S. to quickly apply for working authorization. One reason is that the "official" wedding celebration would be much later due to organization and uncertainty of when the visa will be finally issued. But I don't know if this would look weird somehow.

You can have a civil wedding in the courthouse as soon as you have received your marriage license. Many people did quick marriage and later on the ceremony. Nothing is weird regarding this process, you should be just fine. Remember married within 90 days. Good luck!

I really appreciate your answers. I know, from a personal perspective, I agree it's not very romantic, but we cannot ignore the chance of obtaining a working permission 2-3 months earlier. Unfortunately :( So we would have a court wedding right away and the real ceremony a little later to have if possible friends and families over.

My question was more due to concerns from the legal/USCIS perspective. Thank you very much again

The requirements are that you get married within 90 days of your POE.

Within hours after my then-fiancee's POE arrival, we went to the county records office and obtained a marriage license. There is a 3-day waiting period in Washington state before the license becomes valid and can be used. Four days later we had an appointment with a Seattle municipal judge and had a small civil ceremony at the Seattle Justice Center.

YMMV.

Good luck!

Why does everyone always say "Good Luck"? Even the USCIS agent I spoke to at their office sait it. Luck should have nothing to do with it. This is a factual issue and every case should be decided by facts. But alas, luck has everything to do with it. Just getting someone who knows what they are talking about is a ####### shoot at best.

No legal issue, just the personal side to deal with. Remember, in addition to the work authorization and green card, the sooner you get married, the sooner you can get on your spouse's health insurance, which can be really important (not sure if your existing insurance transfers if you move overseas).

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

My idea is, to marry in court one day after entering the U.S.

Depends on the county in which you are to marry. For example for ours there was a one week period between applying for the marriage license and being able to get on the county judge's schedule.

This sounds like a superb idea and good for you for thinking ahead. Contrary to popular belief the 90 day window is not for trying out a fiancé(e), but rather to insure that people who insist on having a more elaborate initial ceremony have time to plan it.

If you don't have a nice things to say then don't say it at all. This forum is a place to support and give an advice not to be a famous or infamous user. This is my last replied to you and I won't say good luck to you as the matter of a fact I am not wishing you at best of all.

I think many cultures use the term of "good luck" as wishing all the best. I know they do in German, Spanish and I guess in English language. It's not actually meant in a way that you need luck. It's being politely. I agree with you, the K1 process is a formal application and mean to obtain all necessary information. A legit relationship needs no luck. But as in many other things in life, job, interviews...luck is actually never needed if you bring everything needed for it...however, you will always hear people saying "good luck" :) sorry for off topic

Hmmmm. Maybe you misunderstood. No one was flaming you for saying good luck, The point was that in this process, luck should not be part of the equation. It should be fact based (i.e. either you qualify or you don't).

I understand your concern... we still don't know if we will have a court wedding first then the bigger religious wedding with family and friends.

The insurance and work permit are actually big issues. God forbid something happens to you and you don't have insurance...

Yes its better to get civily married ASAP as then you can apply for the AOS right away. The EAD and TA card approval is taking 90 days..so they say. In addition, you can get Health Insurance right away from your job for your spouse (IF they offer it).

If you wait for the civil ceremony than before he or she leave their country make sure you get catastrophic insurance coverage before she gets here to cover any problem.
